(/• I, v ATTACHMENTS: Resolution, Maps, Dakota County APPROVED BY: Memorandum RECOMMENDED ACTION: Motion to Adopt a Resolution Requesting Dakota Co my Update the County Highway 42 Corridor Study BACKGROUND: In 1999,Dakota County,in cooperation with the City of Rosemount and other Dakota County cities completed a corridor study for County Highway 42. The impetus for this study was the designation of County Highway 42 as a principal arterial and the highways role as a contiguous east-west route across Dakota County into Scott County. The primary goal of the Study related to the City was the planning of future access locations east of 145d' Street in conjunction with the City's land use plan at the time. Since the completion of this Study, the City has prepared and adopted an updated land use plan for land along County Highway 42 east of Auburn Avenue to Trunk Highway 52. As part of this land use plan update, staff has worked with Dakota County staff to develop an updated plan for access to County Highway 42 as development occurs. The attached maps show the proposed access modifications on County Highway 42 between 145th Street and Trunk Highway 52 along with the proposed City street system as identified in the draft Transportation Plan. Specific modifications to the study include: 1. The addition of three 3/4 intersections along the corridor to connect with future City minor collector streets. These intersections will help reduce turning movements at busier, signalized intersections, and are not expected to result in any reductions in mobility for CSAH 42. These intersections would be spaced a minimum of mile apart, consistent with other segments of CSAH 42,and consistent with the County's access spacing guidelines. 2. A long-term plan for signalized intersections at CR 73 and CSAH 71 due to expected land uses in the area. These intersections are currently shown as unsignalized full accesses,but as traffic volumes increase,it is likely that these intersections will become signalized as conditions warrant. The resulting signal spacing is 1 —11/2 miles. 3. Inclusion of the current design for the TH 52/CSAH 42 interchange,along with the removal of a right-in/right-out access east of CSAH 71,and removal of a signal with the interchange itself. G:\Streets\COUNTY ROAD 42\UpdateCorridorStudyCC8-6-07.doc i PURPOSE/ACTION REQUESTED • Adopt an update of the County Highway 42 Corridor Study recommendations for Segment 15 of the County State Aid Highway(CSAH) corridor between Trunk Highway(TH) 3 and TH 52 in Rosemount. SUMMA RY An update to the CH 42 Corridor Study recommendations is proposed to ensure the proper development of a roadway system that will adequately support changes in the City of Rosemount's future land use plans, and to meet the intent of the CH 42 Corridor Study to balance the need for mobility and safety on CSAH 42 with the need to maintain a reasonable level of accessibility to support area businesses and residents. Background. In 1999, Dakota County and the City of Rosemount adopted the CH 42 Corridor Study's recommendations to provide an overall vision for future planning along CSAH 42, including a plan for access along Segment 15, between TH 3 and TH 52 (Attachment A). This plan was developed based as part of an overall vision for CSAH 42 that balances the need for mobility and safety with the need to maintain a reasonable level of accessibility to support area businesses and residents. Since 1999, a number of changes have taken place in the area of Segment 15. These changes include: 1. At the time of the study, much of the land adjacent to the corridor between 145th Street and TH 52 was guided for agricultural uses. The City now has a mixture of urban commercial and residential uses planned for the area(Attachment B). 2. The City also adopted a plan for future collector streets to ensure the development of a local roadway system that will adequately support this anticipated development, and will support the principal arterial function of CSAH 42 (Attachment B). 3. Additional preliminary design work for a system interchange at TH 52 has been completed, which is different from the single point interchange shown in the plan. Updated Recommendations: Based on these changes, City and County staff worked together to amend the access plan for Segment 15 consistent with the intent of the CH 42 Corridor Study. The updates are shown in Attachment A, and include: 1. The addition of three 3/4 intersections along the corridor to connect with future City minor collector streets. EN I All of the original partners of the study have been informed of this update, and all were invited to a meeting held on June 27, 2007 to discuss the changes and their consistency with the intent of the original CH 42 Corridor Study recommendations. The update was approved by the Rosemount City Council on August 6, 2007. EXPLANATION OF FISCAL/FTE IMPACT This access plan will be implemented as opportunities arise through development approvals and through roadway improvement projects (such as the TH 52 interchange project). This update will have no impact on the current estimated costs for the interchange project. RESOLUTION Adoption Of An Update To The County Highway 42 Corridor Study Recommendations For Segment 15 WHEREAS, In 1999, a joint study of the CSAH 42 corridor was completed by Dakota and Scott Counties; the Cities of Apple Valley, Burnsville, Lakeville, Prior Lake, Rosemount, Savage, and Shakopee; the Metropolitan Council; the Minnesota Department of Transportation; and the Minnesota Valley Transit Authority; and WHEREAS, the agreed upon goal of the study was to improve the operations of CSAH 42 as a regional highway, while accommodating existing and planned developments; and WHEREAS, Dakota County and the City of Rosemount both adopted the CH 42 Corridor Study to provide an overall vision for future planning along the CSAH 42 corridor; and WHEREAS, Rosemount has since changed its plans for land use in the area of CSAH 42 between TH 3 and TH 52; and WHEREAS, Rosemount has also developed a plan for a system of interconnected collector roadways in the area to support this development and to support the function of CSAH 42 as a principal arterial roadway; and WHEREAS, Dakota County and the City of Rosemount have been working together on system interchange design for the interchange of CSAH 42 and TH 52; and WHEREAS,the County Engineer recommends adoption of this update to the CH 42 Corridor Study recommendations. NOW, THEREFORE, BE IT RESOLVED, That the Dakota County Board of Commissioners hereby adopts this update of the CH 42 Corridor Study for Segment 15 in the City of Rosemount. Motion to Approve a revised Resolution Identifying the Need for Livable Communities Demonstration Account Funding and Authorizing Applications for Grant Funds. DISCUSSION An application for a Livable Communities Demonstration Grant was submitted to the Metropolitan Council on July 16,2007,to request funding for items associated with the implementation of the ' Stonebridge,Core Block East project. This item was approved by the City Council at a special meeting on July 11t. The Metropolitan Council has informed staff that additional information was necessary in section 3 of the resolution.Attached are resolutions rescinding the original resolution and a revised resolution with the necessary facts supporting No. 3 of the findings on page 2 of the original resolution. RECOMMENDED ACTION Approve the two Resolutions. I CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2007- A RESOLUTION RESCINDING RESOLUTION NO. 2007-54 IDENTIFYING THE NEED FOR LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT FUNDING AND AUTHORIZING AN APPLICATION FOR GRANT FUNDS WHEREAS,the City Council for the City of Rosemount approved Resolution No. 2007-54 on July 11,2007, supporting the submittal of an application for Metropolitan Council Livable Communities Demonstration Account grant funds for the project component(s) identified in the application;and WHEREAS,the City Council has determined that it is appropriate to rescind Resolution No. 2007- 54. NOW THEREFORE BE IT RESOLVED, the City Council for the City of Rosemount hereby rescinds Resolution No. 2007-54 in its entirety. Droste,Mayor ATTEST: Amy Domeier, City Clerk Motion by: Second by: Voted in favor: Voted against: Member absent: CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2007- A RESOLUTION IDENTIFYING THE NEED FOR LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT FUNDING AND AUTHORIZING AN APPLICATION FOR GRANT FUNDS WHEREAS, the City of Rosemount is a participant in the Livable Communities Act's Housing Incentives Program for 2007 as determined by the Metropolitan Council, and is therefore eligible to apply for Livable Communities Demonstration Account funds;and WHEREAS, the City has identified a proposed project within the City that meets the Demonstration Account's purposes and criteria and is consistent with and promotes the purposes of the Metropolitan Livable Communities Act and the policies of the Metropolitan Council's adopted metropolitan development guide;and WHEREAS, the City has the institutional, managerial and financial capability to ensure adequate project administration; and WHEREAS, the City certifies that it will comply with all applicable laws and regulations as stated in the grant agreement;and WHEREAS, the City agrees to act as legal sponsor for the project contained in the grant application submitted on July 16, 2007; and WHEREAS, the City acknowledges Livable Communities Demonstration Account grants are intended to fund projects or project components that can serve as models, examples or prototypes for development or redevelopment projects elsewhere in the region, and therefore represents that the proposed project or key components of the proposed project can be replicated in other metropolitan-area communities; and WHEREAS, only a limited amount of grant funding is available through the Metropolitan Council's Livable Communities Demonstration Account during each funding cycle and the Metropolitan Council has determined it is appropriate to allocate those scarce grant funds only to eligible projects that would not occur without the availability of Demonstration Account grant funding. NOW THEREFORE BE IT RESOLVED that,after appropriate examination and due consideration, the governing body of the City: 1. Finds that it is in the best interests of the City's development goals and priorities for the proposed project to occur at this particular site and at this particular time. 2. Finds that the project component(s) for which Livable Communities Demonstration Account funding is sought: RESOLUTION 2007- (a) will not occur solely through private or other public investment within the reasonably foreseeable future; and (b) will not occur within two years after a grant award unless Livable Communities Demonstration Account funding is made available for this project at this time. 3. Represents that the City has undertaken reasonable and good faith efforts to procure funding for the project component for which Livable Communities Demonstration Account funding is sought but was not able to find or secure from other sources funding that is necessary for project component completion within two years and states that this representation is based on the following reasons and supporting facts: The main source of local funding for future Downtown revitalization efforts will come from the tax increment generated by new development, of which this project is the first phase. The project is not expected to generate income until 2011, so no increment will be available before that time. The City and developer have received commitments for a Dakota County Community Development Agency development grant, and the CDA is aiding the project though a tax credit program and Hope funds. Additional funds from the CDA are not expected. While the redevelopment of Downtown has been a key priority for the City of Rosemount for several years, the City faces the need for other investments to meet community goals, a need intensified by the rapid growth of the community. An increased expenditure from City funding sources beyond the already substantial investment the City has committed would deplete resources that should be directed to other community needs and goals. 4. Authorizes its City Administrator to submit on behalf of the City an application for Metropolitan Council Livable Communities Demonstration Account grant funds for the project component(s) identified in the application, and to execute such agreements as may be necessary to implement the project on behalf of the City. BACKGROUND The City acquired the St.Joseph's church property in 2004 to provide land for a new Dakota County Library. One of the western lots of the library site contains a convent at 14400 Cameo Avenue. The building is now empty and will need to be demolished in preparation for construction of the library. DISCUSSION The City received three bids for the completion of the demolition: one from Dahn Construction in the amount of$44,950.00; one from Lloyd's Construction Services, Inc. (LCS) in the amount of $36,385.00;and one from Semple Excavating, Inc. in the amount of$24,320.00. Based on the staffs review, the services needed for demolition of the building at 14400 Cameo Avenue should not exceed $24,320.00 using the estimate provided by Semple Excavating, Inc. Staff is recommending approval of the low bid by Semple Excavating, Inc. for not more than$24,320.00. RECOMMENDATION Staff is recommending approval of the attached resolution. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2007- RESOLUTION AWARDING THE DEMOLITION CONTRACT TO SEMPLE EXCAVATING, INC. FOR $24,320.00 WHEREAS,the City Council for the City of Rosemount acquired the St.Joseph's church property in 2004 to provide land for a new Dakota County Library; WHEREAS,one building on the site has been slated for demolition located at 14400 Cameo Avenue; WHEREAS,the City of Rosemount's Building Official received three bids relating to the demolition of the building;and WHEREAS,the City Council reviewed the proposals submitted by three vendors and Semple Excavating,Inc.was the lowest bidder for the project. NOW THEREFORE BE IT RESOLVED the City Council has chosen Semple Excavating, Inc. and awarded the contract not to exceed$24,320.00. ADOPTED this 6th day of August,2007. William H.
