The fee schedule for planning application fees is based on the average amount of time spent reviewing an
application plus costs to process the application such as publication costs and mailings. With this
particular CUP request, staff spent less than the average amount of time to review the application,but
other CUP requests have cost more time and money to review than the$1,000 application fee recovers.
The High School requested a refund from staff before the CUP went to the Planning Commission, but
staff explained that the City Council has adopted the fee schedule and only the City Council could
determine if a refund or reduction in fee in acceptable. Attached to this report is an email request from
Mike Schwanke, Independent School District#196 Coordinator of Facilities, to refund or reduce the CUP
application fee.
The City has incurred costs for the CUP consisting of eight hours of Senior Planner Zweber staff time,
two hours of Planning Secretary Hanson staff time, the newspaper publishing and 54 letters mailed to the
neighbors for a total cost of approximately$400.
RECOMMENDATION
Recommend approval to the City Council of a conditional use permit for the construction of a ten (10)
foot tall security fence at Rosemount High School.

A RESOLUTION APPROVING THE CONDITIONAL USE PERMIT (CUP)
FOR INDEPENDENT SCHOOL DISTRICT NO. 196 TO CONSTRUCT A TEN THE ROSEMOUNT HIGH SCHOOL(10)
FOOT TALL SECURITY FENCE AT
WHEREAS, the Community Development Department of the City of Rosemount received an
application from Independent School District (ISD)a o . 196 r s ues eti ga a ao diti ona d piping at the

(CUP) to construct a ten (10) foot tall security fencea ga
Rosemount High School located at 3335 142nd Street West.
WHEREAS, the ten (10) foot tall security fence is needed to prevent vandals from accessing the
high school roof;and
WHEREAS, on July 24,2007,the Planning Commission of the City of Rosemount reviewed and
conducted a public hearing for the conditional use permit application of ISD #196;and
WHEREAS,the Planning Commission adopted for ISD #196 to cornsmtrucdt a ten(10) foot tall security
at the City Council
approve the conditional use permit application
fence around the gas meter and associated piping;and
WHEREAS, on August 21,2007,the City Council of the City of Rosemount reviewed the Planning
Commission recommendations for the conditional use permit.
NOW,THEREFORE,BE IT RESOLVED, the City Council of the City of Rosemount hereby
approves the conditional use permit for ISD #196 to construct a ten (10) foot tall security fence
around the gas meter and associated piping located at the Rosemount High School.
ADOPTED this 21'day of August,2007 by the City Council of the City of Rosemount.
