ATTACHMENTS: Resolution, AUAR Order, Development Scenarios, AUAR Schedule APPROVED BY: LJM RECOMMENDED ACTION: Motion to Adopt Resolution Ordering the Preparation of an AUAR for the Rich Valley Golf Course Redevelopment SUMMARY The City Council is being asked to adopt a resolution ordering the preparation of an Alternative Urban Areawide Review (AUAR) for the potential redevelopment of the Rich Valley Golf Course property located east of State Highway 52 and north of County Highway 42 (145th Street East). Scannell Properties has entered into an agreement to purchase the 155 acres currently owned by the Rahn Family with the intent of developing it into a business park that would include a large regional distribution center and series of smaller build-to-suit or spec buildings with a potential wide range of light manufacturing, warehousing, processing, assembly, and other light industrial/business park uses on the property. Based on the proposed size of the distribution center, the development would meet the criteria for a mandatory Environmental Assessment Worksheet (EAW). Given the size and scope of planned future development on the site, the developer has chosen to instead study the entire site through the AUAR process rather than completing multiple EAW’s (or and EIS) over the project area. The advantages of preparing an AUAR for a larger project are as follows: • One comprehensive review is completed for multiple building areas versus individual EAW/EIS with each development proposal. • The AUAR will outline mitigative measures to impacts identified for the proposed development area. • The AUAR allows for the environmental review to be completed earlier in the development process than an EAW or EIS. • The preparation of an AUAR is more cost-effective than multiple EAW’s. An AUAR is required to include a minimum of two development scenarios for the subject area. After consulting with City staff, Scannell is proposing to study two development scenarios with the AUAR, one of which would include their proposed redevelopment of the site for over 2,000,000 square feet of office/warehouse uses and the other would follow the City’s Comprehensive Plan for the property. The City’s future land use map identifies roughly one-third of the project area for future regional commercial uses adjacent to Highway 42, with the remainder guided for business park uses. Staff has had conversations with the developer about leaving space at the corner of Conley Avenue and Highway 42 for commercial development, and the BP Business Park land use guidance does allow for commercial zoning 2 and key intersections within a business park. Scannell is agreeable to a smaller area for commercial zoning, but would like to proceed with an office/warehousing building in latter project phases if no viable commercial user for the corner can be found. The state’s environmental rules specify that the City of Rosemount is the Responsible Government Unit for the AUAR. Scannell has hired Kimley-Horn to prepare the document, and the City plans to contract with WSB to review and process the AUAR on behalf of the City. Once a draft document has been prepared, the City Council will be asked to review the AUAR and authorize distribution of the document for public comment. Under the planned schedule, the City will be reviewing a draft document at its second meeting in May of 2021. CONCLUSION AND RECOMMENDATION Staff recommends approval of the resolution ordering preparation of the AUAR. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION NO. 2021- 36 A RESOLUTION ORDERING PREPARATION OF AN ALTERNATIVE URBAN AREAWIDE REVIEW FOR THE RICH VALLEY GOLF COURSE REDEVELOPMENT WHEREAS, Minnesota Rules Chapter 4410.3610 provides for a substitute form of Environmental Review known as an Alternative Urban Areawide Review (AUAR) process; and WHEREAS, an Alternative Urban Areawide Review (AUAR) process allows for the environmental review of development and associated infrastructure in a particular geographic area within a jurisdiction if the local government unit has an adopted Comprehensive Plan; and WHEREAS, the City of Rosemount has an adopted Comprehensive Plan that identifies future growth and development in the study area; and WHEREAS, the City recognizes the need to plan for future development of land identified in the study area so a coherent development results over the long term and infrastructure facilities are utilized in the most efficient manner; and WHEREAS, the City of Rosemount is the Responsible Governmental Unit (RGU) pursuant to Minnesota Rules Part 4410.3610 Subp. 1; and WHEREAS, the City of Rosemount anticipates redevelopment within the Rich Valley Golf Course site; and WHEREAS, the study area is approximately 155 acres located north of County Road 42 (145th Street E), south of 140th Street East and east of Trunk Highway 52; and WHEREAS, two proposed development scenarios have been identified to be evaluated as part of the AUAR: Scenario 1: This scenario includes 2,140,000 sf of office/warehouse. Scenario 2: This scenario includes 1,080,000 sf of office/warehouse and 415,000 sf of commercial. Scenario 2 is in conformance with the City’s Comprehensive Plan. Scenario 1 would require a comprehensive plan amendment for the increased density of office/warehouse on the southern portion of the site. WHEREAS, the City Council of the City of Rosemount deems an Alternative Urban Areawide Review (AUAR) to be the most appropriate form of environmental review for the redevelopment of the Rich Valley Golf Course. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL, ROSEMOUNT, MN: That the City of Rosemount orders the preparation of an Alternative Urban Areawide Review (AUAR) for the proposed Rich Valley Golf Course Redevelopment study area. The project is proposed by Scannell Properties. This document constitutes an order for review. The study area and development scenarios to be evaluated in the AUAR are described below. AUAR Study Area The AUAR study area encompasses 155 acres, including three existing tax parcels, located north of County Road 42 (145th Street E), south of 140th Street East and east of Trunk Highway 52 (see Figure 1). The development scenarios to be evaluated in the AUAR are described in Table 1 and are based on the proposed land uses and redevelopment identified in the Scannell Properties Development Plan (Scenario 1) and the City of Rosemount 2040 Comprehensive Plan (Scenario 2).
