ATTACHMENTS: Resolution; Site Location; Lot Split APPROVED BY: LJM Exhibit RECOMMENDED ACTION: Motion to adopt a resolution approving a minor subdivision to split the southern twenty acres from the greater eighty-acre parcel. SUMMARY Applicant: City of Rosemount Property Owner: Flint Hills Resources PID: 340150075013 Location: East of Akron Avenue and ½ Miles North of Bonaire Path Area in Acres: 80 Acres Comp. Guide Plan Designation: Agriculture Current Zoning: AG-Agriculture This minor subdivision is being initiated by the City on behalf of Flint Hills Resources to facilitate a land swap between the City and the Minnesota National Guard. Flint Hills Resources will be donating the newly created 20-acre parcel to the City which will subsequently exchange that parcel with the Minnesota National Guard for the northern 20 acres of its property on the west side of Biscayne Avenue. The City Council and Facilities Task Force has identified the property on Biscayne Avenue as a site for a future public works/public safety facility. Because the Minnesota National Guard has a policy of maintaining its current footprint in the metropolitan area, any sale or transfer of property must come with the acquisition of property in equal area. There is not a project associated with the proposed subdivision, and it is unknown if the Minnesota National Guard will ever construct anything on the subject parcel east of Akron Avenue. Any future project would be required to go through the site plan review process and meet the standards contained within the City Code. PLANNING COMMISSION ACTION The Planning Commission held a public hearing during its regular meeting on May 25, 2021 to review the request and receive public comment. The Planning Commission inquired about the land swap and the amount of land proposed to be transferred to the City from the Minnesota National Guard. Staff confirmed that the area of the land north of the Minnesota National Guard facility is twenty acres. No comments were received from the public, and the Planning Commission voted unanimously to recommend approval of the minor subdivision. Minor Subdivision The proposed subdivision will split the southern 20 acres from an 80-acre parcel. The site is within the AG-Agriculture land use designation and is zoned AG-Agriculture. Lot standards for the AG zoning district as well as the proposed dimensions of the new 20-acre parcel are shown on the table below. No new structures are being proposed with this subdivision request. The proposed subdivision meets all the standards of the City Code. Standard Required Proposed Lot Area 2.5 acres 20 acres Lot Width 300 feet 590 feet RECOMMENDATION The Planning Commission and staff recommend approval of the proposed minor subdivision to split the southern 20 acres from an 80-acre parcel. This recommendation is based on the information contained within this report. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2021-45 A RESOLUTION APPROVING A MINOR SUBDIVISION TO SPLIT 20 ACRES FROM AN 80-ACRE P ARCEL WHEREAS, the City of Rosemount is initiating the request for a minor subdivision, concerning property legally described as: The East Half of Section 15, Township 115 North, Range 19 West, Dakota County, Minnesota WHEREAS, the Minor Subdivision approval will create two parcels legally described as: The South Half of the Southwest Quarter of the Southeast Quarter of Section 15, Township 115 North, Range 19 West, Dakota County, Minnesota. And The East Half of Section 15, Township 115 North, Range 19 West, Dakota County, Minnesota, except the South Half of the Southwest Quarter of the Southeast Quarter of Section 15, Township 115 North, Range 19 West, Dakota County, Minnesota. WHEREAS, on May 25, 2021, the Planning Commission of the City of Rosemount held a public hearing and reviewed the request; and WHEREAS, on May 25, 2021, the Planning Commission recommended approval of the requested applications, subject to conditions; and WHEREAS, on June 15, 2021, the City Council of the City of Rosemount reviewed the Planning Commission’s recommendations. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Minor Subdivision.
