ATTACHMENTS: Amendment Resolution, Rosemount Car Club Final Plat APPROVED BY: LJM RECOMMENDED ACTION: Motion to adopt a resolution amending City Council Resolution 2020-44 approving the Rosemount Car Club Simple Plat to allow payment of development fees to be deferred until construction occurs on Lot 1, Block 1. SUMMARY The City Council is being asked to consider an amendment to the Resolution approving the Rosemount Car Club Simple Plat. The amendment is requested to help facilitate the transfer of Outlot A of the subdivision from JJT Financial, LP to Seefried Industrial Properties in advance of future zoning approvals for a regional warehouse and distribution center on the west side of the Rosemount Business Park. JJT would retain ownership of Lot 1, Block 1 of the plat, but has asked that the City allow the development fees associated with this lot to be paid off once development occurs on the property, rather than at the time of platting (which is normally required when property is subdivided into buildable lots). Staff is recommending approval of the amendment to add the underlined text depicted in red to the original conditions of approval for the Rosemount Car Club subdivision. Seefried Properties has applied for a Planned Unit Development, Preliminary and Final Plat, Site Plan, and Conditional Use Permit to construct a large regional warehouse and distribution center on the western edge of the Rosemount Business Park. This project will partially be located on property owned by JJT Financial that is currently platted as the JJT Business Park 1st Addition. A little over a year ago, the City approved a project for a car condominium development on the JJT land that proposed to split a large outlot they owned into a 4-acre parcel for the car club development and a larger outlot for future development. The car club project did not move forward; however, Seefried Properties has recently agreed to purchase the larger outlot as part of its distribution center project. JJT would like to now record the Car Condo plat to allow the transfer of the outlot to Seefried (while retaining ownership of Lot 1, Block 1 for future development). The Rosemount Car Club plat was approved by the City in March of 2021, and is still within the time frame for recording under the City’s subdivision regulations. The resolution approving the Car Condo plat included three conditions, one of which requires the payment of park dedication fees and another that references the City Engineer’s comments concerning utility trunk area charges. Normally the City would not sign the plat until the area fees are paid. Staff has estimated the fees for Lot 1, Block 1 of the Rosemount Car Club plat as follows: Park Fee in Lieu of Land Dedication $34,465 ($8,500/acre x 4.29 acres) Sanitary Sewer Trunk Charge $4,612 ($1,075/acre x 4.29 acres) Watermain Trunk Charge $27,885 ($6,500/acre x 4.29 acres) Storm Sewer Trunk Charge $29,450 ($6,865/acre x 4.29 acres) 2 The storm sewer trunk charge may be slightly lower depending on the size of any future on-site ponding on the property. A future building on Lot, 1, Block 1 will also be required to pay the appropriate connection charges and other permit fees associated with a building permit. In order to accommodate the request for flexibility concerning payment of the required development fees, staff is recommending revisions to the original resolution approving the Car Club plat to allow payment of these fees to be delayed until a building permit or grading permit is issued for Lot 1, Block 1. The amended resolution still requires the payment all fees, and in practice will not delay the City’s payments since the alternative (not recording the plat) leaves the property as an unbuildable outlot. The property to be conveyed to JJT Financial will be replatted for the distribution center later this summer, and the City will be collecting fees on a march larger area for this project at that time. CONCLUSION AND RECOMMENDATION Staff and recommends approval of an amendment to the Resolution approving the Rosemount Car Club Simple Plat that will defer payment of City development fees for Lot 1, Block 1 of the subdivision until a building permit or grading permit is issued for this lot. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2021-51 A RESOLUTION AMENDING CITY COUNCIL RESOLUTION 2020-44 APPROVING A SIMPLE PLAT FOR ROSEMOUNT CAR CLUB WHEREAS, the Planning Department received an application for approval of a Simple Plat for Rosemount Car Club to replat an existing 35.34-acre parcel into a 4.3-acre building site and larger outlot for future development on property legally described as follows: Outlot A, JJT Business Park First Addition, Dakota County, Minnesota WHEREAS, the City of Rosemount published a public hearing notice in the official newspaper concerning the application on February 14, 2020 and mailed notice to property owners within 500 feet of the subject property on February 13, 2020; and, WHEREAS, the Planning Commission of the City of Rosemount conducted a public hearing as required by ordinance for the purpose of receiving public comment regarding the proposed Rosemount Car Club Simple Plat on February 26, 2020; and, WHEREAS, the Planning Commission reviewed the application on February 26, 2020 and found it consistent with the criteria for simple plat review outlined in the Subdivision Ordinance; and, WHEREAS, the Planning Commission adopted a motion to recommend approval of the application for a Simple Plat on February 26, 2020. WHERAS, the City Council approved the Rosemount Car Club Simple Plat subject to conditions on March 17, 2020; and WHEREAS, on or about June 28, 2021, City Council received a request from the applicant to amend the conditions of the Rosemount Car Club Simple Plat to allow deferment of the required development fees until construction occurs on Lot 1, Block 1 of the subdivision. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount does hereby approve an amendment to Resolution No. 2020-44 approving the Rosemount Car Club Simple Plat subject to the following amended conditions: 1)Incorporation of recommendations from the City Engineer in a review memorandum datedFebruary 20, 2020, relative to drainage, grading, easements, utilities, storm watermanagement, and other subjects covered in the review.2)Vacation of existing drainage and utility easements over Outlot A of the JJT Business Parksubdivision.3)Payment of $36,465 in lieu of park land dedication for Lot 1, Block 1 ($8,500 per acre x 4.29acres).4)The fee in lieu of park land dedication and all utility trunk area charges noted in the CityEngineer's memorandum referenced in Condition (1) must be paid in full prior to the issuance of any building permit or grading permit for Lot 1, Block 1.
