APPROVED BY: LJM RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the Drainage and Utility Easements over Outlot B, Dunmore 2nd Addition. BACKGROUND With the approval of the Final Plat for Dunmore 2nd Addition, a blanket drainage and utility easement was recorded on the outlot encompassing the final phase of development in the Dunmore neighborhood. To accommodate the development of Dunmore 3rd Addition, a vacation of the drainage and utility easement over Outlot B, Dunmore 2nd Addition is necessary. This action is typical when there are multi-phased developments in a larger preliminary plat. Appropriate new drainage and utility easements will be recorded with the Dunmore 3rd Addition final plat which was approved by Council at its June 15 meeting. RECOMMENDATION Staff recommends the City Council call the Public Hearing and approve the vacation of drainage and utility easements over Outlot B, Dunmore 2nd Addition, subject to the recording of the final plat of Dunmore 3rd Addition. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2021-52 A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY EASEMENT OVER OUTLOT B, DUNMORE 2ND ADDITION WHEREAS, the City of Rosemount received an application from Copper Creek Development (Applicant) for the Final Plat of Dunmore 3 rd Addition; WHEREAS, on June 15, 2021, the City of Rosemount City Council reviewed and approved the Final Plat for Dunmore 3rd Addition; and WHEREAS, the vacation of the existing drainage and utility easement legally described below is required before the Final Plat can be recorded for Dunmore 3rd Addition; and WHEREAS, the City Council reviewed this request and conducted a public hearing on July 6, 2021. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easement, legally described as: All drainage and utility easements lying over, under, and across OUTLOT B, DUNMORE 2ND ADDITION, according to the recorded plat thereof, Dakota County, Minnesota. subject to the recording of the Final Plat of Dunmore 3 rd Addition.
