RECOMMENDED ACTION: Motion to adopt a Resolution approving the Vacation of the
Drainage and Utility Easement over Outlot I, Prestwick Place 18th Addition.
BACKGROUND
With the approval of the Final Plat for Prestwick Place 18th Addition, a blanket drainage and utility
easement was recorded on the outlot encompassing the final plat area for Prestwick Place 22nd Addition.
To accommodate the development of Prestwick Place 22nd Addition, a vacation of the drainage and utility
easement over Outlot I, Prestwick Place 18th Addition is necessary.
This action is typical when there are multi-phased developments in a larger preliminary plat. Appropriate
new drainage and utility easements will be recorded with the Prestwick Place 22nd Addition final plat which
was approved by Council at its December 3, 2019 meeting. The delay between the vacation and the
original plat approval was due to an oversight that was noticed by staff and the applicant. The final plat
for Prestwick Place 22nd Addition has been recorded with Dakota County, and all required drainage and
utility easements were dedicated with that plat.
RECOMMENDATION
Staff recommends the Council hold the Public Hearing and approve the vacation of drainage and utility
easements over Outlot I, Prestwick Place 18th Addition.

A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS OVER OUTLOT I, PRESTWICK PLACE 1 arH ADDITION
WHEREAS, the City of Rosemount received an application from U.S. Home Corporation (Applicant) for
the Final Plat of Prestwick Place 22nd Addition;
WHEREAS, on December 3, 2019, the City of Rosemount City Council reviewed and approved the Final
Plat for Prestwick Place 22nd Addition; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is required
for development of Prestwick Place 22nd Addition; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on July 6, 2021.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the
Vacation of the Drainage and Utility Easements, legally described as:
All drainage and utility easements lying over, under, and across OUTLOT I, PRESTWICK PLACE
18TH ADDITION, according to the recorded plat thereof, Dakota County, Minnesota.
ADOPTED this 6th day of July 2021, by the City Council of the City of Rosemount.
