RECOMMENDED ACTION: Motion to adopt a resolution approving the vacation of
drainage and utility easements over a portion of the Rich Valley Golf Course redevelopment
site
BACKGROUND
The City Council reviewed and approved a proposal to redevelop the Rich Valley Golf Course at its
meeting on October 19, 2021. During staff’s review of the proposal, existing drainage and utility
easements related to the stormwater ponding within the golf course were identified. In order to record the
plat and proceed with development of the site, those existing easements must be vacated.
New drainage and utility easements are shown on the final plat that was approved by Council and will be
dedicated with that plat’s recording. A sketch showing the easements to be vacated, as well as the final
plat for Rich Valley First Addition on which the new easements are shown, are included in the
attachments.
RECOMMENDATION
Staff recommends the Council approve the vacation of the drainage and utility easements over a portion of
the Rich Valley Golf Course Redevelopment area as shown on the attached easement vacation sketch.

RESOLUTION 2021-89
A RESOLUTION APPROVING THE VACATION OF DRAINAGE AND UTILITY EASEMENTS
OVER A PORTION OF THE RICH VALLEY GOLF COURSE REDEVELOPMENT SITE
WHEREAS, the City of Rosemount received an application from Scannell Properties #527, LLC. for the
vacation of certain drainage and utility easements within the Rich Valley Golf Course redevelopment site;
and
WHEREAS, on September 28, 2021 the City of Rosemount Planning Commission reviewed and approved
a Site Plan and Building Design Review for Scannell Properties #527, LLC. to allow the construction of a
warehouse and distribution center; and
WHEREAS, the vacation of the existing drainage and utility easements legally described below is required
for construction ; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on November 1, 2021.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the
Vacation of the Drainage and Utility Easements, legally described as:
Drainage and Utility Easement as described in Document Number 1676153
That part of the following described parcel of land in the City of Rosemount:
The Northeast Quarter of the Northwest Quarter and the West half of the Northeast Quarter, all in Section
30 Township 115, Range 18, Dakota County, Minnesota.
Which lies within the following permanent easements for drainage and utility purposes:
A strip of land 20.00 feet in width over that part of said the Northeast Quarter of the Northwest Quarter,
Section 30 Township 115, Range 18, Dakota County, Minnesota, the centerline of which is described as
follows:
Commencing at the Northwest corner of said Northeast Quarter of the Northwest Quarter; thence South
00 degrees 15 minutes 13 seconds West, assumed bearing along the West line of said Northeast Quarter of
the Northwest Quarter, a distance of 1111.83 feet to the point of beginning of said centerline to be
hereinafter described; thence North 78 degrees 11 minutes 29 seconds East a distance of 145. 79 feet to a
point to be hereinafter referred to as "Point A"; thence continuing North 78 degrees 11 minutes 29 seconds
East a distance of 20.00 feet and there terminating.
Said strip of land is to extend by its full width from said West line to a line drawn Northerly and Southerly,
perpendicular to said centerline and passes through the point of termination.
And also that part of said Northeast Quarter of the Northwest Quarter described as follows:
Beginning at said above referenced "Point A"; thence North 02 degrees 31 minutes 51 seconds East a
distance of 246.29 feet; thence North 89 degrees 00 minutes 00 seconds East a distance of 113.21 feet;
thence South 19 degrees 24 minutes 43 seconds East a distance of 70. 72 feet to a point to be hereinafter

referred to as "Point B"; thence South 05 degrees 28 minutes 14 seconds East a distance of 214.91 feet;
thence South 82 degrees 44 minutes 47 seconds. West a distance of 114.03 feet; thence North 49 degrees 26
minutes 59 seconds West a distance of 72.30 feet to the point of beginning.
And also a strip of land 20.00 feet in width over that part of said Northeast Quarter of the Northwest
Quarter, the centerline of which is described as follows:
Beginning at said above referenced "Point B"; thence North 89 degrees 15 minutes 34 seconds East a
distance of 586.68 feet; thence North 52 degrees 44 minutes 53 seconds West a distance of 118.93 feet to a
point to be hereinafter referred to as "Point C"; thence continuing North 52 degrees 44 minutes 53 seconds
East a distance of 20.00 feet and there terminating.
Said strip of land is to extend by its full width from the Westerly line of the last above described permanent
easement to a line drawn Northwesterly and Southeasterly, perpendicular to said centerline and passes
through the point of termination.
And also that part of said Northeast Quarter of the Northwest Quarter described as follows:
Beginning at said above referenced "Point C"; thence North 02 degrees 46 minutes 56 seconds West a
distance of 253. 79 feet; thence South 87 degrees 16 minutes 55 seconds East a distance of 322.86 feet;
thence South 11 degrees 29 minutes 32 seconds West a distance of 147.88 feet to a point to be hereinafter
referred to as "Point D"; thence continuing South 11 degrees 29 minutes 32 seconds West a distance of
358.98 feet; thence South 76 degrees 06 minutes 16 seconds West a distance of 170.85 feet; thence North 09
degrees 17 minutes 51 seconds East a distance of 97.90 feet; thence North 74 degrees 11 minutes 19
seconds West a distance of 90.41 feet; thence North 02 degrees 46 minutes 56 seconds West a distance of
33.43 feet to the point of beginning.
And also a strip of land 20.00 feet in width over that part of said Northeast Quarter of the Northwest
Quarter and also over part of the West half of the Northeast Quarter of said Section 30, the centerline of
which is described as follows:
Beginning at said above referenced "Point D"; thence South 69 degrees 09 minutes 01 seconds East a
distance of 77.18 feet; thence South 44 degrees 20 minutes 47 seconds East a distance of 596.86 feet; thence
South 56 degrees 12 minutes 11 seconds East a distance of 249.19 feet; thence South 87 degrees 46 minutes
48 seconds East a distance of 218.60 feet; thence North 75 degrees 50 minutes 22 seconds East a distance
of 155.09 feet; thence North 48 degrees 01 minutes 40 seconds East a distance of 132. 73 feet; thence North
82 degrees 38 minutes 32 seconds East a distance of 231.24 feet to the East line of said West half of the
Northeast Quarter and there terminating.
Said strip of land is to extend by its full width from the Westerly line of the last above described permanent
easement to said East line of the West half of the Northeast Quarter
ADOPTED this 1st day of November 2021, by the City Council of the City of Rosemount.
