BACKGROUND
The 2022 Street Improvement Project, City Project 2022-01, was included as part of the 2020-2029 Capital
Improvement Plan. The streets identified for this improvement through the City’s pavement management
evaluation are shown in the attached map. The project is proposed to consist of pavement rehabilitation.
DISCUSSION
The initial scope of the project consisted of two distinct types of work. The proposed scope for the Jay
Simons subdivision consisted of a full depth reconstruction and extension of utilities on:
• Bacardi Avenue West between the edge of pavement and 128th Street West
• 128th Street West between Bacardi Avenue West and Bengal Avenue West
• 130th Way between Bengal Avenue and 130th Street West
• Bengal Avenue between 128th Street West and 130th Street West
However, additional investigation has shown there are a number of property, easement, and right of way
concerns in this area. As a result, staff is recommending this work be delayed until 2023 to allow for
needed resolution to these issues.
The rest of the project scope consisted of pavement rehabilitation on the following streets:
• Biscayne Avenue West between 130th Street West and the end of pavement, approximately 2,670
feet north
• 126th Street West between Biscayne Avenue West and Bacardi Avenue West
• Danbury Way between McAndrews Road (CSAH 38) and the City Limit
• Chinchilla Avenue between McAndrews Road (CSAH 38) and the southern cul-de-sac
• 127th Court West between Chinchilla Avenue and the cul-de-sac
This would provide a new road surface for the residences abutting the street. This is the scope that staff is
recommending for completion in 2022.
A feasibility report was prepared by WSB and Associates, Inc. (WSB) for the pavement rehabilitation work
and is available for review in the City Engineer’s office. The report reviews the existing conditions,

proposes improvements, details costs and funding sources and estimates proposed assessments.
Scope
The existing conditions are shown in the following table. The streets vary from 24 feet to 32 feet in width.
In addition, Danbury Way and a small portion of Biscayne Ave have existing bituminous barrier curb.
Where no curb exists, the road has an existing ditch section, that generally functions adequately. There are
no existing municipal utilities in these neighborhoods as they are outside the Municipal Urban Service Area
(MUSA).
Proposed improvements would include reducing the roadway width of Chinchilla and 127th Court West to
24’ and maintain the existing widths on 126th Street and Biscayne Ave. Danbury Way has bituminous curb
that has outlived its service life and replacing that with concrete barrier curb would provide a more robust
and durable edge to the pavement. Eliminating that curb would require substantial grading as no drainage
swale exists and establishing a ditch section would be difficult due to tree cover and elevation differences.
Danbury Way south of McAndrews was reconstructed in a similar manner due to the original construction
with bituminous curbing.

Staff is also recommends including ribbon curb as a bid alternate in the design for areas that currently have
only a bituminous edge. A final award decision can be made after bids have been received. A review of
the ribbon curb cost would be provided to Council showing a funding breakdown for several options on
assessment/city funds. Staff would propose showing estimated assessments based on 0%, 25%, 50%,
75% and 100% assessed cost. As a reference point, Deepwoods Court the assessed cost was 100% and
the cost was approximately $5,200 per parcel which added approximately 3,500 of ribbon curb.
A concrete ribbon curb edge provides the following benefits to the bituminous section:
• Protects the edge of the bituminous pavement from cracking/breaking particularly when large
vehicles (i.e. garbage trucks) drive along the edge
• Bituminous edge is constrained and supported
• Provides a more durable surface for plowing
• Reduces shoulder maintenance of aggregate edge
• Eliminates the migration of weeds through the pavement surface.
• Long life span (50+ years) means minimal maintenance is required during future pavement
rehabilitation projects

Public Engagement
City staff hosted a neighborhood meeting on October 28, 2021. Approximately 12 residents within the
pavement rehabilitation project attended an open house style meeting where staff and the consultant were
available to answer questions and discuss the project scope. Generally, the residents were supportive of
the project. Comments concerned assessments, construction scope, access during construction and some
minor drainage issues.
Cost and Funding
The Feasibility Report prepared an initial estimate for the work to be performed. This cost will be refined
during design should City Council order the project at the Improvement Hearing. The table below details
the estimated total project cost for each of the areas. These costs include 10% construction contingency
and a 25% indirect cost. Additionally, the cost for concrete ribbon curb and necessary storm sewer
improvement are included for each of the three project areas.
This project would be funded via Street Capital Improvement Funds, Special Assessments and the Storm
Utility Fund. The estimated amounts are detailed in the table below.
A preliminary assessment roll is included in the Feasibility Report. Assessments are proposed in
accordance with the Rosemount Special Assessment Policy with 35% of the Street Improvement costs will
be assessed and the remaining 65% will be paid by the Street CIP Fund. The assessments are proposed as
a unit assessment, meaning the amount will be the same for all single-family properties with a driveway
access to a street within the project area.

Based on the Feasibility Report this project is feasible, necessary and cost-effective from an engineering
stand point. As a result, staff is recommending that a Public Improvement Hearing be held on December
7, 2021. This is the next necessary step under Minnesota Statutes Chapter 429. A presentation of the
proposed improvements will be made as part of the Improvement Hearing.

Staff recommends Council adoption of the attached resolution receiving the feasibility report, calling for
the improvement public hearing for the 2022 Street Improvement Project, City Project 2022-01.

A RESOLUTION ACCEPTING THE FEASIBILITY REPORT AND
CALLING A PUBLIC HEARING FOR IMPROVEMENT FOR THE
2022 STREET IMPROVEMENT PROJECT, CITY PROJECT 2022-01
WHEREAS, pursuant to Resolution 2021-57 adopted August 2, 2021, a report has been prepared
by WSB and Associates with reference to proposed Improvement No. 2022-01, the following streets
with pavement rehabilitation:
• Biscayne Avenue West between 130th Street West and end of pavement, approximately 2,670 feet
• 126th Street West between Biscayne Avenue West and Bacardi Avenue West
• Danbury Way between McAndrews Road (CSAH 38) and the City Limit
• Chinchilla Avenue between McAndrews Road (CSAH 38) and the southern cul-de-sac
• 127th Court West between Chinchilla Avenue and the cul-de-sac, and;
WHEREAS, this report was received by the council on November 16, 2021, and
WHEREAS, the report provides information regarding whether the proposed improvement is
necessary, cost-effective, and feasible; whether it should best be made as proposed or in connection
with some other improvement; the estimated cost of the improvement as recommended; and a
description of the methodology used to calculate individual assessments for affected parcels.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ROSEMOUNT, MINNESOTA:
1. The Council will consider the improvement of such street in accordance with the report and
the assessment of abutting property for all or a portion of the cost of the improvement
pursuant to Minnesota Statutes, Chapter 429 at an estimated total cost of the improvement
of $1,722,400.
2. A public hearing shall be held on such proposed improvement on the 7th day of December,
2021, in the Council Chambers of the City Hall at 7:00 p.m. and the clerk shall give mailed
and published notice of such hearing and improvement as required by law.
