Regular Meeting Call to Order: Pursuant to due call and notice thereof, the Regular Meeting of the Planning Commission was held on October 26, 2021. Acting Chair Rivera called the meeting to order at 6:30 p.m. with Commissioners Marlow, Schmisek, Thiagarajan, and Hebert. Absent was Commissioners Kenninger and Reed. Also, in attendance were Community Development Director Kienberger, Senior Planner Nemcek, Economic Development Coordinator Van Oss and Recording Specialist Bodsberg. The Pledge of Allegiance was said. Additions to Agenda: None. Audience Input: None. Consent Agenda: 4.a. Approval of the September 28, 2021, Regular Meeting Minutes. MOTION by Schmisek. Second by Marlow. Ayes: 5. Nays: 0. Public Hearing: 5.a. Request by George and Laura Bruestle for a Minor Subdivision to create a new six-acre buildable lot and a 2.96- acre outlot from an existing 11.59-acre parcel, and a request for a Variance from the requirement that buildable lots must contain frontage along a public street. (21-45-MS & 21-46-V) Senior Planner Nemcek explained that the applicant has requested to continue this item to the November 23, 2021, Planning Commission meeting. MOTION by Schmisek to continue the item until the November 23, 2021, Planning Commission meeting. Second by Hebert. Ayes: 5. Nays: 0. Motion Passes. 5.b. Request by Nate Stromberg & Heather Hansen for a Variance to reduce the side yard setback in the RR-Rural Residential Zoning District from thirty (30) feet to fourteen (14) in order to construct an attached garage addition. (21-54-V) Senior Planner Nemcek gave a presentation and summary of the staff report for the Planning Commission. The public hearing opened at 6:39 pm. Public Comments: Mark McDonough, 4430 Upper 135th Street, stated that he has no issues with the proposed item. Richard Ketterling, 4363 Upper 135th Street, stated that he thinks that this project will only improve the neighborhood. MOTION by Hebert to close the public hearing. Second by Marlow. Ayes: 5. Nays: 0. Motion Passes. The public hearing closed at 6:41 pm. Additional Comments: None. PLANNING COMMISSION REGULAR MEETING MINUTES October 26, 2021 PAGE 2 MOTION by the Board of Appeals and Adjustments Schmisek to Adopt a Resolution Approving a Variance from the RR-Rural Residential Side Yard Setback for Structures from thirty (30) to fourteen (14) feet at 4393 Upper 135th Street West. Subject to building permit approval. Second by Thiagarajan. Ayes: 5. Nays: 0. Motion Passes. Discussion: 6.a. Zoning Ordinance Text Amendment Discussion Changing Maximum Building Height in the R-4 High Density Residential Districts and the Downtown District. (21-54-TA) Economic Development Coordinator Van Oss gave a presentation and summary of the staff report for the Planning Commission. Community Development Director Kienberger gave further explanation of the proposed text amendment. The Planning Commissioners discussed the proposed change and agreed that the 4 or 5 stories should also include a maximum height for the building. MOTION by Rivera to Recommend the City Council Adopt an Amendment to Sections 11-4-9 and 11-4-11 of the Zoning Ordinance Related to Maximum Building Heights in the R-4 High Density Residential District and the Downtown District. Recommend the City council hold a public hearing and that staff adopt the maximum stories and max height of the building. Second by Hebert. Ayes: 5. Nays: 0. Motion Passes. Reports: None.
