SUMMARY Applicant: City of Rosemount Property Owner: State of Minnesota – Department of Administration Location: 14221 Biscayne Avenue Area in Acres: 49.38 Acres Comp. Guide Plan Designation: Public Institutional Current Zoning: PI-Public Institutional This minor subdivision is being initiated by the City on behalf of the Minnesota National Guard to facilitate a land swap between the City and the Minnesota National Guard. Flint Hills Resources will be donating a recently approved 20-acre parcel to the City which will subsequently exchange that parcel with the northern 20 acres of its property on the west side of Biscayne Avenue that is being proposed by City staff. The City Council and facilities task force have identified the property on Biscayne Avenue as a site for a future public works/public safety facility. Because the Minnesota National Guard has a policy of maintaining its current footprint in the metropolitan area, any sale or transfer of property must come with the acquisition of property in equal area. PLANNING COMMISSION ACTION The Planning Commission held a public hearing to review this request during its meeting on December 20, 2021. The Commission had questions about the operations that would be occurring at the new facility, and the need for the facility. Staff provided a summary of the reasoning behind the construction of the new facility. The Commission also inquired about potential buffering of the future facility. In addition to letters received by staff and the Commission from the homeowners’ association immediately north of the site, a representative of the HOA provided comment to speak into record their concerns. Many of the concerns raised by the HOA were related to the site plan, which will be developed through a process that considers public feedback. Additional comments related to traffic concerns including those related to access into the site coming from the street within the HOA that extends to the northern boundary of the subject parcel. Staff was unable to provide specifics related to the site plan of the facility but reiterated that there will be a public process through which adjacent and affected neighborhoods could provide feedback on the creation of the site plan. The Planning Commission voted unanimously to recommend approval of the subdivision. 2 BACKGROUND Minor Subdivision The proposed subdivision will split the northern 20 acres from the 49.38-acre parcel. The site is within the Public/Institutional land use designation and is zoned PI-Public/Institutional. Lot standards for the PI zoning district as well as the proposed dimensions of the new 20-acre parcel are shown on the table below. Lot standards such as setbacks and lot coverage will be reviewed through the site plan review process before the Planning Commission when plans for the public works/public safety facility are finalized. The proposed subdivision meets all the dimensional standards of the City Code. This recommendation is based on the information contained within this report and comments received during the public hearing. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2022-XX A RESOLUTION APPROVING A MINOR SUBDIVISION TO SPLIT THE NORTHERN 20 ACRES FROM THE PROPERTY LOCATED AT 14221 BISCAYNE AVENUE WHEREAS, the City of Rosemount is initiating the request for a minor subdivision, concerning property legally described as: Lot 3, Auditor’s Subdivision One (1), Rosemount, Dakota County, Minnesota WHEREAS, the Minor Subdivision approval will create two parcels legally described as: That part of Lot 3, Auditor's Subdivision One (1), Rosemount, Dakota County, Minnesota, which lies north of the following described line: Commencing at the northeast corner of the Northeast Quarter of Section 29, Township 115 North, Range 19 West, Dakota County, Minnesota, also being the northeast corner of said Lot 3; thence on an assumed bearing of South 00 degrees 37 minutes 39 seconds West, along the east line of said Northeast Quarter, also being the east line of said Lot 3, a distance of 905.04 feet to the point of beginning of said line to be described; thence South 88 degrees 36 minutes 48 seconds West, a distance of 1110.57 feet, more or less, to the west line of said Lot 3. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Minor Subdivision. Minor Subdivision to Split the Northern 20 Acres from the property located at 14221 Biscayne Avenue. (21-53-CPA) Senior Planner Nemcek gave a presentation and summary of the staff report for the Planning Commission. In addition to describing the proposed lot split, Mr. Nemcek also provided a timeline for the creation of the plans as well as the construction of the facility. Commissioner Hebert inquired what will be placed on this property. Nemcek stated that the City of Rosemount will be building a new building for the Police Department and Public Works Department. Commissioner Reed inquired what the buffering will entail. Nemcek stated that it will be mostly space and bushes. The public hearing opened at 6:39 pm. Public Comments: Dwight Nelson, 13978 Blarney Court, stated that he is representing the Connemara Homeowners Association. Mr. Nelson reiterated the concerns held by the members of the HOA with regards to the future facility. Mary Hoban, 13976 Blarney Court, stated that she is concerned about the increase in traffic along Bonaire Avenue and that she has enjoyed living next to a field. A new public facility will be a big change. Ms. Hoban expressed that she would not like to see an extension of Blanca Avenue used as an access point into the new facility. MOTION by Reed to close the public hearing. Second by Hebert. Ayes: 5. Nays: 0. Motion Passes. The public hearing closed at 6:45 pm. Additional Comments: Senior Planner Nemcek stated that most of the concerns are related to the site plan of the future facility, and that it is too early to know the answers to many of the questions posed by the neighbors, but that the City’s intention is to involve the adjacent neighborhoods in the planning process to receive feedback and incorporate their thoughts and concerns into the design of the plans for the site.
