RECOMMENDED ACTION: Motion to adopt a resolution approving the vacation of the blanket drainage and utility easement over Outlot A and B, Ardan Place First Addition. BACKGROUND The Council is being asked to consider a request by Tamarack Land Development to vacate a blanket drainage and utility easement that was dedicated over all of Outlot A and B of Ardan Place First Addition in order to facilitate development of Ardan Place Second Addition. This action is typical when there are multi-phased developments, and as part of the approval, new drainage and utility easements will be recorded with the Ardan Place Second Addition, if approved by the City Council. RECOMMENDATION Staff recommends the Council approve the vacation of the blanket drainage and utility easements over Outlot A and B, Ardan Place First Addition, subject to the recording of the final plat of Ardan Place Second Addition. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2022-24 A RESOLUTION APPROVING THE VACATION OF THE BLANKET DRAINAGE AND UTILITY EASEMENT OVER OUTLOT A AND B, ARDAN PLACE FIRST ADDITION WHEREAS, the City of Rosemount received an application from Tamarack Land Development (Applicant) for the Final Plat of Ardan Place Second Addition; WHEREAS, on February 15, 2022, the City of Rosemount City Council reviewed and approved the Final Plat for Ardan Place Second Addition; and WHEREAS, the vacation of the existing blanket drainage and utility easement legally described below is required for development of Ardan Place Second Addition; and WHEREAS, the City Council reviewed this request and conducted a public hearing on February 15, 2022. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Blanket Drainage and Utility Easement, legally described as: Blanket drainage and utility easement encumbering all of OUTLOT A AND B, ARDAN PLACE, Dakota County, Minnesota, according to the recorded plat thereof. Subject to the recording of the Final Plat of Ardan Place Second Addition.
