ATTACHMENTS: Resolution APPROVED BY: LJM RECOMMENDED ACTION: Motion to Approve the Resolution Terminating the Employment of Police Officer Jason Waage Effective April 5, 2022 BACKGROUND Police Officer Jason Waage was hired on April 12, 2007. On March 15, 2022, Mr. Waage informed the City that he was no longer able to perform the duties of a police officer or any other position with the City of Rosemount. Therefore, formal action needs to be taken to separate Mr. Waage from employment. RECOMMENDATION Staff recommends that the Council make a motion to approve the resolution terminating the employment of Police Officer Jason Waage, effective April 5, 2022. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2022 - 35 A RESOLUTION SEPARATING JASON WAAGE FROM EMPLOYMENT WITH THE CITY OF ROSEMONT WHEREAS, Jason Waage (“Employee”) was initially hired as an employee with the City of Rosemount (“City”) on April 12, 2007; and WHEREAS, the City Council for the City has the exclusive authority to terminate the employment of persons working for the City; and WHEREAS, after consultation with the Police Chief and City Attorney, the City Administrator is recommending that it is in the best interest of the City that the employment of Jason Waage be terminated effective immediately; and WHEREAS, the recommendation is based on the Employee’s inability to perform the essential functions of the position, as determined by Employee and his care providers and previously provided to the City; and WHEREAS, following a meeting with Employee on March 15, 2022, the City Administrator provided a letter to Employee dated March 22, 2022, advising him of the recommendation to terminate his employment and offering him the opportunity to provide additional information before the Council acts on the recommendation; and WHEREAS, Employee did not request a meeting with the City Administrator, nor did he provide additional information disputing the conclusion that he is no longer able to perform the essential functions of a police officer; and WHEREAS, the City Council relies on the professional expertise and opinion of the City Administrator obtained during the administration of the City’s business as well as the conclusions of the Employee’s health care providers concerning the Employee’s inability to perform the essential functions of his job as a police officer; and WHEREAS, the City inquired of Employee whether he could perform in any other capacity for the City and Employee indicated he was unable to do so. NOW, THEREFORE, BE IT RESOLVED: 1. The above-referenced recitals are incorporated herein to this Resolution. 2. The City Council of the City of Rosemount approves the separation of the employment of Jason Waage, effective April 5, 2022. 1 3. The City Council directs that staff provide Employee with notice of the Council’s action. 4. The City Council directs staff and the City Attorney to take all appropriate actions and to prepare any needed documents to facilitate the directives of the Council as provided in this Resolution. th Resolution adopted this 5 day of April, 2022. ____________________________________ William H.
