SUMMARY The Council is being asked to consider a request by U.S. Home Corporation, dba Lennar, for approval of a final plat to create Lot 1, Block 1 and Outlot A for the approved Talamore (previously Dunmore Farms) subdivision. Instead of using the minor subdivision process, which combines the approval of the preliminary and final plats into a single process, the final plat process is being used since the preliminary plat process has already been approved. In the future, the developer will submit a final plat that will subdivide the first addition of Talamore into buildable lots. Staff finds the application consistent with the Talamore Preliminary Plat that was approved by the City Council in December 2021 and recommends approval of this application subject to the conditions detailed in the motion above. The preliminary plat consisted of 76.82-acres to develop a mixture of single-family homes and townhomes. The single-family portion of the site will be divided into lots of traditional dimensions as well as smaller lots featuring narrower widths. With this final plat the original parcel will be split into two parcels, Outlot A consists of 64.69-acres and Lot 1, Block 1 consists of 12.13-acres which are being retained by the current owners. The larger parcel will contain the proposed single-family homes and townhomes. The smaller parcel will continue to be farmed by the landowner and currently has no plan to be developed in the near future. Owners: Keith, Joylynn, Kurt, and Alan Bester Applicant/Developer: U.S. Home Corporation, dba Lennar Preliminary Plat Acres: 76.82 Met Council Net Acres: 65.13 Comprehensive Plan Guiding: LDR-Low Density Residential, MDR-Medium Density Residential, CC- Community Commercial Approved Zoning: R1 PUD-Low Density Residential Planned Unit Development, R3 PUD- Medium Density Residential Planned Unit Development, C4-General Commercial PLANNING COMMISSION ACTION The Planning Commission reviewed this request as part of the consent agenda during its meeting on April 26, 2022 and voted unanimously to recommend approval. BACKGROUND The 76-acre development area is currently used for agricultural purposes and is located north of County Road 42 one half mile east of Akron Avenue. Until recently Flint Hills Resources (FHR) held a right of first refusal on the property which City staff expected FHR would exercise when the time came that the property owner was willing to sell the property. Instead, Lennar was able to acquire the property and is proposing a mixed density residential development on the northern 60.69 acres of the subject property. The Rosemount comprehensive land use plan has designated the 20 acres of land immediately north of the Connemara Trail extension as Medium Density Residential and the northern 40 acres of the development area is designated as Low Density Residential. The development falls within the density ranges of the two land-use designations and is consistent with the comprehensive plan. In addition to the land in the northern portion of the property the developer has also acquired 5 acres of land on the south side of the Connemara Trail extension which is guided for commercial development but will most likely be used for stormwater ponding. The Bester family, which currently owns the property, is retaining the 12.13-ares, in the southeast portion and will continue their farming operations. ISSUE ANALYSIS Legal Authority. The final plat application is Quasi-Judicial because the City has a set of standards and requirements for reviewing this type of application that is described in detail below. Generally, if the final plat meets the ordinance requirements it must be approved. Plat The proposed plat shows the existing subject parcel divided into two separate parcels, Lot 1, Block 1 is 12.13-acres in size and Out lot A is 64.49-acres. Outlot A will contain the proposed 225 residential lots, 86 of which will accommodate townhomes. Additional outlots will also be located within the parcel for stormwater ponding and as well as a city park. Lot 1, Block 1 will be located to the south of the larger parcel with the future extended Connemara Trail dividing the two. It currently has no plans to be developed and will most likely continue to be farmed by the landowner. This parcel could potentially be developed in the future, but it would have to abide by the future land use it is designated for which is commercial use. The developer has indicated that full build-out of the site will occur in three to four phases. The City will prepare a subdivision agreement when the final plat for the first phase of Talamore is submitted. CONCLUSION AND RECOMMENDATION The Planning Commission and Staff are recommending approval of the Final Plat for Talamore to create Lot 1, Block 1 and Outlot A. This recommendation is consistent with the conditions of approval of the Talamore (previously Dunmore Farms) Preliminary Plat and Planned Unit Development Master Development Plan with Rezoning. 2 CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2022-49 A RESOLUTION APPROVING THE FINAL PLAT FOR TALAMORE WHEREAS, U.S. Home Corporation, dba Lennar, (Applicant) has submitted an application to the City of Rosemount for a Plat concerning property legally described as follows: The West One-half (W1/2) of the Northwest Quarter (NW1/4) of Section Twenty-six (26), Township One Hundred Fifteen (115), Range Nineteen (19), except the East 24 rods of the South 20 rods, Dakota County, Minnesota. WHEREAS, on April 26, 2022, the Planning Commission of the City of Rosemount reviewed the Final Plat for Talamore; and WHEREAS, on April 26, 2022, the Planning Commission recommended approval of the Final Plat for Talamore, subject to conditions; and WHEREAS, on May 3, 2022, the City Council of the City of Rosemount reviewed the Planning Commission’s recommendations and the Final Plat for Talamore. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Rosemount hereby approves the Final Plat for Talamore, subject to the following conditions: a. The applicant shall meet all Dakota County Plat Commission Approval Conditions b.Trunk area charges for the parcel described as Lot 1, Block 1 shall be paid when the parcel is developed.
