ATTACHMENTS: Resolution; Site Location; Easement Vacation Sketch and Descriptions; Greystone APPROVED BY: LJM th 5 Addition Final Plat; Bray Hill Final Plat RECOMMENDED ACTION: Motion to adopt a resolution approving the vacation of drainage and utility easements to accommodate the construction of Bray Hill. BACKGROUND The Council is being asked to consider a request by Builders Lot Group, LLC to vacate existing drainage and utility easements within the proposed Bray Hill subdivision located at 1102 Bonaire Path East. The Planning Commission recommended approval of a Preliminary Plat, Planned Unit Development Master Development Plan with Rezoning and a Final Plat for Bray Hill at their March th 29 meeting. The Bray Hill subdivision will consist of 49 single-family residential lots and the proposed easement vacations are necessary to allow that development to move forward. The applicant has prepared a description and sketches of all separate easements proposed for vacation. Appropriate new drainage and utility easements will be recorded with the Bray Hill final plat, if approved by City Council. RECOMMENDATION Staff recommends the Council approve the vacation of the drainage and utility easements within the proposed Bray Hill Subdivision located at 1102 Bonaire Path East. WHEREAS, the City of Rosemount received an application from Builders Lot Group, LLC (Applicant) for the Final Plat of Bray Hill; WHEREAS, on May 3, 2022, the City of Rosemount City Council reviewed and approved the Final Plat for Bray Hill; and WHEREAS, the vacation of the existing drainage and utility easements legally described below is required for development of Bray Hill; and WHEREAS, the City Council reviewed this request and conducted a public hearing on May 3, 2022. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easements, legally described as: All those particular drainage and utility easements embraced within Lot 1, Block 1, as dedicated on the plat of GREYSTONE 5TH ADDITION, Dakota County, Minnesota.
