Motion to adopt a resolution approving a Major Amendment to the Amber Fields Planned Unit Development Agreement. 3. Motion to authorize the Mayor and City Clerk to execute a Major Amendment to the Amber Fields PUD Agreement. BACKGROUND The City Council is being asked to consider a request by Maplewood Development for approval of the preliminary and final plats of Amber Fields Second Addition and a major amendment to the Amber Fields Planned Unit Development to create 190 single family lots and 111 townhome lots. The single family lots will be a combination of traditional single family lots with widths of 65’ and smaller single-family lots that are consistent with recently approved developments such as Bray Hill and Talamore Farms. The request to amend the PUD is necessary to allow for the dimensional standards of the smaller single-family lots related to minimum lot area as well as to accommodate some reconfiguration in the placement of the roads and housing types within the preliminary plat area. The changes, individually, would likely only require a minor amendment to the PUD. When taken as a whole, staff determined the changes meet the threshold of a Major Amendment which includes a review by the planning commission during a public hearing. 2 The Planning Commission and staff are recommending approval of the request by the developer, subject to the conditions included in the recommended action and the Engineer’s Memo dated April 7, 2022. The Commission asked about the timing of various aspects of the overall Amber Fields development such as the parks, the 148th Street West spine road, and development to the south of the 2nd Addition. The parks will be built as soon as possible following mass grading. That will probably occur in 2023. The construction of 148th Street West will be constructed first along with the Auburn Avenue, Akron Avenue, and Abbeyfield Avenue extensions. Finally, the land just south of Amber Fields 2nd will be developed in accordance with the University’s timeframe as it relates to the mining leases that are currently in place in that vicinity. The applicant wanted to clarify that one of the conditions recommended by staff was already addressed in the subdivision agreement. Staff has reviewed the agreement and has removed that condition from the attached resolution. The Planning Commission voted unanimously to recommend approval of the applicant’s request. BACKGROUND The present applications are the latest step in a long process of planning for development within UMore Park. The developer received Planned Unit Development approval with rezoning from the City Council at its September 7, 2021 meeting. The Planned Unit Development anticipated a total of 265 traditional 65’ wide single-family lots, 366 55’ wide villa (detached townhome) and single-family lots, as well as 596 townhome lots. These are in addition to various multi-family and senior housing projects within Amber Fields. With this current request, the developer is proposing 87 45’ wide single-family lots, 103 65’ wide single-family lots, and 111 townhome lots, which constitutes approximately 15% of the total residential units anticipated by the Amber Fields Master Development Plan. This is a slight increase of 8 units from what was shown on the original development plan, but within the anticipated density for the overall development area. Legal Authority Preliminary and Final Plat requests are quasi-judicial decisions for the Planning Commission meaning that the Planning Commission is acting as a judge to determine if the regulations within the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance are being followed. Major Planned Unit Development Amendments are a legislative decision because of the code deviations being requested. Legislative decisions give the Planning Commission more latitude, but consideration should be given to the PUD standards of previously approved developments in the City as well as the PUD standards of the 3 other similar neighborhoods. The proposed amendment is consistent with other recently approved developments that contain smaller single-family lots. While the original PUD did not include 45’ wide lots, the developer did acknowledge that they would be courting builders of that type of product and asked staff to consider future amendments such as this. General Subdivision Design The preliminary plat area is located on the western edge of the Amber Fields development area. It is bound on the west by the future extension of Auburn Avenue, which will be constructed in two phases as development occurs. The to-be-constructed 148th Street West runs along the north side of the preliminary plat area and connects Auburn Avenue with Akron Avenue. Within the preliminary plat area, Road A connects with 148th Street west and travels south, then east, before looping back to Auburn Avenue. Road A provides access to several local streets, one of which connects to 148th Street West, and private streets within the townhome neighborhood located in the northwest corner of the preliminary plat. The smaller lot single-family homes are sited to provide somewhat of a transition between the townhomes and larger single-family lots. The layout of the preliminary plat is generally consistent with what was included in the Master Development Plan, with only a few alterations to the locations of streets and the addition of the smaller single-family lots. Land Use and Zoning The site is designated for MUR-Mixed Use Residential land uses, which can include a range of housing types from single-family homes on traditional sixty-five foot lots to townhomes. The zoning districts in which the preliminary plat is located are R1-Low Density Residential and R3-Medium Density Residential. The Amber Fields Planned Unit Development Agreement includes several deviations from the Zoning Ordinance. In addition to dimensional standards the table below compares the proposed preliminary plat to the standards of the Amber Fields PUD. The applicant is requesting an amendment to the PUD to reduce the minimum lot area, and the proposed standards are included in the table below and reviewed further in this report. The Amber Fields PUD also includes a deviation from the maximum lot coverage as follows: The maximum lot coverage shall be fifty-five percent (55%) for lots less than 8,000 square feet, fifty percent (50%) for lots between 8,000 and 9,000 square feet, forty-five percent (45%) for lots between 9,000 and 10,000 square feet, and forty percent (40%) for lots over 10,000 square feet. This standard will be reviewed as part of the building permitting process to ensure compliance. Phasing The applicant has provided a phasing plan that shows development initially occurring in the northern 4 portion of the preliminary plat. This area contains all of the townhome lots as well as some 45’ and 65’ single family lots. As development continues and mining finishes up, Auburn Avenue will be extended to the southern end of the second phase of development shown which contains the remainder of the single- family lots. At that point, the third access into the preliminary plat area will be created. Amendment to the Amber Fields Planned Unit Development Agreement The Amber Fields Planned Unit Development agreement included several deviations from the code related to lot dimensions within the single-family areas of the development. As indicated above, the applicant is requesting a revision to the dimensional standard related to lot area to reduce the minimum lot area from 6,500 square feet for corner lots as allowed by the Amber Fields PUD to 5,400 square feet and 8,500 square feet to 7,200 square feet for corner lots. The preliminary plat meets all the other dimensional standards of the Amber Fields Planned Unit Development Agreement. The amendment will also memorialize the updated street and lot layouts as well as the inclusion of forty- five-foot-wide lots in this phase of the development where medium density townhomes were originally anticipated. A secondary access is provided by Road C which connects with 148th Street West and travels south and then west to connect with Road A. Additional local roads are located internally to the preliminary plat area connect with Roads A and C. The City’s engineer reviewed the street plan and provided comments in the attached memo dated April 7, 2022. The radius of at least one of the curves must be widened. Sidewalks are provided on at least one side of all streets except cul-de-sacs. In the case of Road A that connects with public park in the area when houses only front one side of the street, the sidewalk is placed on the side of the street adjacent to the park which also has homes fronting it. As Auburn Avenue is constructed with the second phase of development, trail and sidewalk will be built on either side of the roadway, consistent with other collector roads in Rosemount. A trail connection traversing an area of open space is shown between the future extension of Auburn Avenue to Road A near the parking area for the public park and the internal trail system surrounding the central open area. The plans provided by the applicant show 4’ wide sidewalks, which is one foot narrower than they should be, which is another comment provided by the City Engineer in the attached memo. Final construction plans shall be updated to show 5’ sidewalks. Parks The Parks and Recreation staff has reviewed the park dedication requirement for Amber Fields Second Addition as part of the overall Master Development Plan in order to take into account the multiple playgrounds and extensive open space within the development. Therefore, there is no park dedication requirement for this specific phase of Amber Fields. The street and sidewalk system within the preliminary plat provide direct access to the trails and parks, including a playground immediately adjacent to the preliminary plat south of the eastern section of single-family homes. Tree Preservation A tree inventory was conducted for the overall Amber Fields development area, and a total of 1,983 caliper inches of trees were identified for replacement following the formula laid out in the City Code. The initial 5 phase of construction, which includes 148th Street West and the extension of Auburn Avenue to it, includes 325 caliper inches of trees as mitigation. An additional 85 caliper inches are provided within the Amber Fields Second Addition preliminary plat. The leaves a total of 1,573 caliper inches of trees to be provided as replacement in future phases. Already 20% of the required replacement are accounted for with this request, and staff is confident the remainder will be made up as development continues. Landscaping In the single-family portions of the preliminary plat, the landscaping plan provided by the applicant shows a total of 220 trees, or one tree per interior lot and two per corner lot. This is in conformance with the requirements of the City Code. The City Code also requires for multi-family/townhome developments a minimum of 8 trees plus one tree per unit. In this case that is a total of 119 trees. The applicant’s landscape plan meets that requirement, and it provides foundation plantings in excess of one per ten linear feet of building perimeter. Additional trees are shown on the plan as replacements for tree removals. These are located along the trail connection between Auburn Avenue and Road A and along the rear of townhomes abutting Auburn Avenue and 148th Street West. A total of 372 trees will be planted with this development, therefore a landscaping surety in the amount of $122,760 (372 trees x $300 plus 10%) is required as a condition of approval. Utilities The site is served by sanitary sewer located within 148th Street West. The majority of the site is served by a sewer line extending south along Road A, while a secondary sewer line in Road C serves the remainder. Initially, water will be provided to the site via an 8” main within Road A. A 16” main will be constructed with the extension of Auburn Avenue, which will connect with the main in Road A. Stormwater is managed across the entire site with detention and retention ponds located in the central open area of Amber Fields. Engineering Review The City’s engineer has provided a memorandum containing comments related to the plans provided. Of note, sidewalks should be widened to 5’ and the radius of at least on curve must be altered. The engineer’s memo is included with the attachments. Final Plat The final plat contains the residential parcels and dedicated right of way. Additionally, the final plat contains three outlots. Outlot A encompasses the common areas of the townhome neighborhood. Outlots B and C contain the multi-use trails that connect the central open space with Auburn Avenue and 148th Street West, respectively. The final plat is consistent with the preliminary plat provided by the applicant. RECOMMENDATION The Planning Commission and staff are recommending approval of the preliminary and final plats and the major amendment to the Amber Fields planned unit development agreement, subject to conditions in the recommended action and contained within the engineer’s memorandum dated April 7, 2022. This recommendation is based on information provided by the applicant and reviewed in this report. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2022 - XX A RESOLUTION APPROVING THE PRELIMINARY PLAT AND FINAL PLAT FOR AMBER FIELDS SECOND ADDITION WHEREAS, the City of Rosemount received a request for Preliminary Plat and Final Plat approval from Maplewood Development, concerning property legally described as: Outlots I, G and M, AMBER FIELDS, Dakota County, Minnesota WHEREAS, on April 26, 2022, the Planning Commission of the City of Rosemount held a public hearing and reviewed the Preliminary and Final Plats for Amber Fields 2nd Addition; and WHEREAS, on April 26, 2022 the Planning Commission recommended approval of the Preliminary Plat and Final Plat for Amber Fields Second Addition, subject to conditions; and WHEREAS, on May 17, 2022, the City Council of the City of Rosemount reviewed the Planning Commission’s recommendations. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Preliminary Plat and Final Plat for Amber Fields Second Addition, subject to the following conditions: a.Execution of a subdivision agreement. b. Construction plans shall be updated to show five (5) foot wide sidewalks. c. Conformance with all requirements of the City Engineer as detailed in the attached memorandum dated April 7, 2022 (and associated stormwater review memo dated April 7, 2022) d.Payment of $112,760 as a landscape surety. e.Outlots B and C shall be dedicated to the City. f.The developer shall work with the City to name all public streets and parks within the preliminary plat area. g.Trees installed on individual lots shall be planted in the front yard in a location that does not interfere with curb stops or individual sewer or water connections. h.Payment of trunk area charges in the amount of: i. Sanitary Sewer Trunk Charge: $1,075/acre ii. Watermain Trunk Charge: $6,500/acre iii. Request by Maplewood Development for Approval of the Amber Fields 2nd Addition Preliminary and Final Plats and a Major Amendment to the Amber Fields Planned Unit Development (22-16-FP, 22-17-PP, 22-27-AMD). Senior Planner Nemcek gave a presentation and summary of the staff report for the Planning Commission. Commissioner Reed inquired about the timeline to the park being completed. Nemcek stated that based on conversations that he has had with the developer of Amber Fields, they would like to get the amenities completed as soon as possible. Having the amenities completed will hopefully be a selling point for potential home builders. Reed inquired about the timing of the underpass on Highway 42. Nemcek stated that will be located east of Akron Ave. The underpass will connect the DCTC property to the Community Center property. The underpass should be happening in the next couple of years. Commissioner Hebert inquired if the construction of 148th Street West included in phase one of the development. Nemcek stated that street will be a part of the developer’s original construction prior to the start of phase one. Chair Kenninger inquired as to when the future road to the south and run east/west will get developed. Nemcek stated that the extension of Boulder Ave will happen when the University of Minnesota sells more of their land in that area. The public hearing opened at 7:12 pm. Public Comments: Mario Cocchiarella, 1128 Harmon Place, Suite 320, Minneapolis, Maplewood Development, Inc. and Applicant, stated that there is an error under item e according to the already signed master development agreement. The first phase of building will be done by Pulte Homes. Commissioner Reed inquired if the individual builders would also be developing the proposed parks. Mr. Cocchiarella stated that the parks will be built by Maplewood Development. MOTION by Reed to close the public hearing. Second by Rivera. Ayes: 5. Nays: 0. Motion Passes. The public hearing closed at 7:20 pm. Additional Comments: Commissioner Hebert inquired about the mining timeline that would affect the construction of Auborn Avenue. Nemcek stated that part of the mining operation is scheduled to be completed 2028, but they are ahead of schedule so it may be sooner. Street A is the primary local street providing access to both single family areas and the townhouse area. Street A has seven local streets intersecting it and two intersections with private streets. Auburn Avenue extends along the westly plat boundary of Amber Fields Second Addition and will be constructed with the development of the second phase of Amber Fields Second Addition. Auburn Avenue provides a private street intersection and a public street intersection into Amber Fields Second Addition. Phase 1 development of Amber Hills Second Addition has one primary route for access and egress which is 148th Street to Road A, until phase 2 is developed and Auburn Avenue is extended south. Three Outlots are identified in the preliminary plat of Amber Fields Second Addition, Outlot A is the common ground area adjacent to the townhouse development and will be owned and maintained by the homeowner’s association, Outlot B extends between Auburn Avenue and Street A and contains an 8-foot multipurpose trail, and Outlot C extends sout h from 148th Street and contains a trail and storm sewer facilities. Outlots B and C will be deeded to the city. 1. The site plan identifies sidewalk extensions at 4 feet wide. The city standard is a 5- foot-wide sidewalk. 2. The plans do not provide a typical section for the local str eets. 3. Several vertical curves need to be lengthened to have a minimum vertical curve length of 90 feet. 4. The vertical curve for Road M needs to be lengthened to 350 feet. 5. Provide a profile for Auburn Avenue. The development Fees are indicated below based on the 2021 Schedule of Rates and Fees. ▪ Sanitary Sewer Trunk Charge: $1,075/acre ▪ Watermain Trunk Charge: $6,500/acre ▪ Storm Sewer Trunk Charge: $6,865/acre GRADING AND DRAINAGE The northern 400 feet of the preliminary plat has its runoff directed to the north to the proposed ponding area (Basin 1918) located adjacent to the MCES pumping station. This area includes two-thirds of the townhouse area and the single family units adjacent to Street B and one-half of Street C. This ponding area proposes to connecting its 100-year storm sewer outfall to a segment of the City’s interceptor storm sewer system being developed with the project. A large portion of the plat, in the central area of Amber Fields Second Addition, has its runoff directed to the most westerly ponding area of the Amber Fields greenway. The pond is located in Outlot H, Amber Fields. The ponding area discharges to an infiltration area located to the east, southeast. The south and easterly portion of the subdivision has its runoff directed to the central ponding area of the Amber Fields greenway. The emergency overflow elevation identified at block 11 must be reset. 7. A few driveway grades are not identified and a driveway on Block 17 exceeds 10%. Provide a schematic of vehicle clearance and street and driveway grades for the townhouse area, utilize a 9.0 driveway grade. 8. Place the rear yard drainage swale behind lots 5, 6, & 7, block 9 within a drainage and utility easement. 9. The proposed emergency overflow elevation by lots 20, & 21, block 9 does not meet requirements for lot 35. 10. The proposed emergency overflow elevation by lots 17, & 18, block 9 does not meet requirements for lot 1, block 5.. 11. Show existing contours adjacent to the plat for 200 feet beyond the plat boundary. 12. Show existing contours adjacent to the west of Auburn Avenue for 200 feet beyond the plat boundary. SANITARY SEWER AND WATERMAIN – UTILITY PLAN Amber Fields Second Addition sanitary sewer system extends within Road A from the sanitary sewer in 148th Street. This sewer extension provides service to almost the entire subdivision. Nineteen single family lots are provided sanitary sewer from an extension within Road C from 148th Street. Eight-inch sanitary sewer is extended the entire length of Road A providing connection points for sewers extending in the intersecting streets. A sanitary sewer stub to the subdivision boundary is provided in Road N and at the southwest corner of the subdivision for future extension to the south. Sixteen-inch trunk watermain is identified to be extended within Auburn Avenue south from 148th Street. The trunk watermain extends to the southwest corner of the subdivision and connects to the lateral watermain within Amber Fields Second Addition at the proposed street intersections. This watermain is identified to be constructed with the second phase of the subdivision. Eight-inch watermain is identified to extend from the trunk watermain in 148th Street at Road A and Road C. The eight-inch watermain is proposed to extend along each street and is stubbed to the subdivision boundary within Road N. The proposed watermain provides a looped system for the northern 2/3 of the Second Addition. The southerly single-family lots adjacent to Road I will be on a dead-end extension until the second phase is developed. 13. Gate valve and fire hydrant placement will be detail reviewed with the construction plans for the subdivision. STORM SEWER Storm sewer design and layout will be reviewed with the Surface Water Management submittal which was submitted on 03-18-2022. 14. Storm sewer catchbasins can not be located within driveways. 15. Detail review of the storm sewer system and design will be completed with the construction plans for the subdivisio n. SURFACE WATER MANAGEMENT The proposed Surface Water Management plan for the preliminary plat is currently being reviewed. Comments included in the Surface Water Management review shall be incorporated in the project design. Tree plantings should allow space for access and maintenance of proposed infrastructure. 16. Tree plantings are identified in the boulevard of Road A adjacent to the townhouse development. All other locations tree planting is beyond the boulevard. General Infrastructure design shall be completed in accordance with the City of Rosemount’s Engine ering Guidelines and Standards. Infrastructure construction shall be completed in accordance with the latest edition of the City’s General Specifications and Standard Detail Plates for Street and Utility Construction.
