Minutes of the May 17, 2022 Regular Meeting ProceedingsROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MAY 17, 2022 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, May 17, 2022, at 7:00 p.m. in Rosemount Council Chambers 2875 145th Street West and virtually via Zoom. Mayor Droste called the meeting to order with Councilmembers Block and Freske attending. Councilmembers Essler and Weisensel were absent. Staff present included the following; •City Administrator Martin, Finance Director Malecha, Police Chief Dahlstrom, Public Works Director Egger, City Engineer Erickson, Community Development Director Kienberger, Senior Planner Nemcek, and Economic Development Coordinator Van Oss The Pledge of Allegiance was recited. APPROVAL OF AGENDA Motion by Freske Second by Block Motion to Adopt the Agenda Ayes: 3. Nays: None. Motion carried. PRESENTATIONS 3.a. Proclamation of National Public Works Week and Recognition of Public Works Employees City Administrator highlighted a proclamation naming May 15-21, 2022 as Public Works Week. Mayor Droste read the proclamation. Motion by Droste Second by Freske Motion to approve proclamation. Ayes: Block, Droste, Freske, Nays: None. Motion carried. PUBLIC COMMENT William Olson, 12539 Chinchilla Avenue, addressed Council with concerns about a business operating in a residential area. City Administrator Martin stated that staff has been working on the issue. The business has been working on a purchase agreement to relocate. PUBLIC HEARINGS 7.a. 2022 Street Improvement Project, City Project 2022-01, Assessment Hearing and Adopt Assessment Roll City Engineer Erickson presented information on the 2022 Street Improvement Project regarding, assessment calculations and project schedule. Mayor Droste opened the public hearing opened at 7:18 p.m. Bob Kubat, 12536 Chinchilla Avenue, requested that City Council consider postponing the project until the business has been moved out of the residential area. Mr. Kubat stated concern regarding the semi-truck traffic related to the business operations. William Olson, 12539 Chinchilla Avenue, addressed the Council about the semi-truck traffic and the wear and tear it will cause on the new roads. Bill Huffstutler, 3296 127th Court West, expressed concern about the truck traffic, the costs associated with the street improvement and the wear and tear that will occur due to the business’s truck traffic. Motion by Droste Second by Block Motion to close the public hearing 7:22 p.m. Mayor Droste questioned what the weight limit is for the residential road, such as Chinchilla Avenue, once they have been reclaimed. City Engineer Erickson advised that the road limits would be 7-tons per axle. Staff will discuss with the contractor to ask about postponing project until the business has been relocated. Motion by Block Second by Freske ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MAY 17, 2022 Motion to adopt a Resolution Approving the Assessment Roll for the 2022 Street Improvement Project, City Project 2022-01 Ayes: Freske, Block, Droste Nays: None. Motion carried. 7.b. Host Approval for Conduit Debt Issuance Finance Director Malecha gave a brief presentation regarding the approval of the debt issuance. Due to the project taking place within Rosemount, the City must give approval for another entity to issue bonds. Mayor Droste opened the public hearing opened at 7:27 p.m. No public comment received. Motion by Droste Second by Freske Motion to close the public hearing 7:28 p.m. Motion by Freske Second by Block Motion to Approve the Joint Power Agreement with the Cities of Hampton, Landfall Village, and New Prague and Adopt a Resolution giving host approval to the Cities of Hampton and Landfall Village. Ayes: Block, Droste, Freske Nays: None. Motion carried. 7.c. City Council Establishment of Connemara Industrial Development District and the Adoption of a Development Plan for a Recreation Facility Economic Development Coordinator Van Oss presented on the establishment of an Industrial Development District to facilitate the necessary financing for the new development. The area is zoned as commercial. There will not be any industrial businesses in the area. Mayor Droste opened the public hearing opened at 7:31 p.m. No public comment received. Motion by Droste Second by Block Motion to close the public hearing 7:32 p.m. Motion by Block Second by Freske Motion to Approve a Resolution Approving the Establishment of the Connemara Industrial Development District and the Adoption of a Development Plan. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MAY 17, 2022 Ayes: Freske, Block, Droste Nays: None. Motion carried. UNFINISHED BUSINESS None NEW BUSINESS 9.a. Request by Maplewood Development for approval of the Amber Fields Second Addition Preliminary and Final Plats and a Major Amendment to the Amber Fields Planned Unit Development Senior Planner Nemcek presented an overview of the project. The amendment to the Planned Unit Development is necessary to allow for the dimensional standards of smaller single-family lots related to minimum lot area. Motion by Freske Second by Block Motion to adopt a resolution approving the preliminary and final plats for Amber Fields Second Addition, subject to conditions. Ayes: Block, Droste, Freske Nays: None. Motion carried. Motion by Block Second by Freske Motion to adopt a resolution approving a Major Amendment to the Amber Fields Planned Unit Development Agreement. Ayes: Droste, Freske, Block Nays: None. Motion carried. Motion by Freske Second by Block Motion to authorize the Mayor and City Clerk to execute a Major Amendment to the Amber Fields PUD Agreement. Ayes: Freske, Droste, Block Nays: None. Motion carried. 9.b. Comprehensive Land Use Plan Amendment and Rezoning of Land in the Highway 3 and CSAH 46 Area Senior Planner Nemcek briefly discussed the proposed amendment and rezoning based on the conclusions drawn from the Small Area Plan. Based on the market’s lack of interest in the site for commercial development, the staff has put together a small area plan for the sites located on either side of Highway 3 and CSAH 46. The plan was created to make use of the vacant land near the intersection. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS MAY 17, 2022 Councilmember Freske inquired about when the area was last rezoned. Senior Planner Nemcek stated in 2014 the area was rezoned with the South Urban Gateway review, which recommend that area be a good fit for commercial purposes at the time. The area has not had any new interest for commercial business development since 2014. Motion by Block Second by Freske Motion to adopt a resolution approving a Comprehensive Plan Amendment to change the land use designation of the subject properties from CC-Community Commercial to CP- Business Park. Ayes: Block, Droste, Freske Nays: None. Motion carried. Motion by Block Second by Freske Motion to adopt an ordinance rezoning the site from LI-Light Industrial, PI-Public Institutional, C3-Highway Commercial, and GI-General Industrial to BP-Business Park. Ayes: Droste, Freske, Block Nays: None. Motion carried. ANNOUNCEMENTS 10.a. Staff Updates City Administrator Martin provided various updates; the splash pad will be opened on Friday, May 27th and the Spring Cleanup event will be on Saturday, May 21st at Dakota County Technical College. Chief Dahlstrom recognized National Police Week. Chief Dahlstrom thanks the men and women who has served on the Rosemount Police Department and those entering the police work force. 10.b. Upcoming Community Calendar Mayor Droste reviewed the calendar of events and upcoming meetings.
