Preliminary Plat Acres: 17.23 Acres Met Council Net Acres: 17.23 Acres Residential Lots Created: 182 Townhome Lots Gross Density: 10.56 Units/Acre Net Density: 10.56 Units/Acre Comprehensive Plan Guiding: MUR-Mixed Use Residential Current Zoning: R3-Medium Density Residential Surrounding Land Uses North: Mixed Use Residential East: Existing Parks/Open Space South: Community Commercial West: Mixed Use Residential 2 The City Council is being asked to consider a request by Maplewood Development for approval of the preliminary and final plats of Amber Fields Third Addition and a major amendment to the Amber Fields Planned Unit Development to create 182 townhome lots. A total of 24 buildings will be constructed on the site with 19 of the buildings consisting of 8 dwelling units and 5 of the buildings consisting of 6 dwelling units. The request to amend the PUD is necessary to allow for the 8 dwelling unit buildings to be constructed because currently within the City’s Code only a maximum of 6 dwelling units per building are allowed. Staff is recommending approval of the request by the developer, subject to the conditions included in the recommended action and the Engineer’s Memo dated May 11, 2022. PLANNING COMMISSION ACTION The Planning Commission reviewed the applicant’s requests at its meeting on May 24, 2022 at which a public hearing was held to receive public comment. The Commission questioned if this subdivision would be subject to the maximum 4 dwelling units per building since it is located adjacent to a R1 zoning district. Staff informed the Commission that with the amendment to the Planned Unit Development the standards can be changed to be in conformance with the City’s code. Staff also mentioned that the subdivision shows the mixture of six to eight attached units and that with the master development plan of Amber Fields much of the density was already accounted for during that process. The Commission also inquired about if there would be sidewalks throughout the subdivision, which staff informed the Commission that they will be required to have a pedestrian access to the adjacent trails and towards the central park feature. Lastly, the Commission asked about the proposed 54 guest parking spots that are proposed for the area and what was the plan on making that work. Staff explained that a condition of approval is to provide the additional 54 guest parking spots within the subdivision prior to City Council review. Since the May 24, 2022 Planning Commission meeting staff received an updated submittal of the preliminary plat documents which included plans with the additional 37 guest parking’s stalls that were required to be added prior to City Council review. The Planning Commission voted unanimously to recommend approval of the applicant’s request. BACKGROUND The present applications are the latest step in a long process of planning for development within UMore Park. The developer received Planned Unit Development approval with rezoning from the City Council at its September 7, 2021 meeting. The Planned Unit Development anticipated a total of 265 traditional 65’ wide single-family lots, 366 55’ wide villa (detached townhome) and single-family lots, as well as 596 townhome lots. These are in addition to various multi-family and senior housing projects within Amber Fields. The Amber Fields 2nd Addition preliminary plat, final plat, and major amendment to the planned unit development was approved by the City Council at its May 17, 2022 meeting. The 2nd addition will consist of 87 45’ wide single-family lots, 103 65’ wide single-family lots, and 111 townhome lots, which constitutes approximately 15% of the total residential units anticipated by the Amber Fields Master Development Plan. This is a slight increase of 8 units from what was shown on the original development plan, but within the anticipated density for the overall development area. With this request, the developer is proposing 182 townhome lots throughout the 17.23-acre section of the Amber Fields Development. This addition is located on the most eastern side of Amber Fields extending from 148th Street West and is adjacent to the west side of Akron Avenue. It is also directly across Akron Avenue from the UMore Ballfields. This development will consist of 24 townhome buildings with a mixture of the buildings containing both 6 dwellings units per building or 8 dwelling units per building. The subdivision is planned to be built in two phases, starting with the first phase which will consist of the northern portion of the site and the second phase will be the remaining portion to the south. This addition will make up approximately 9% of the total residential units anticipated by the Amber Fields Master Development Plan. 3 Legal Authority Preliminary and Final Plat requests are quasi-judicial decisions for the Planning Commission meaning that the Planning Commission is acting as a judge to determine if the regulations within the Comprehensive Plan, Zoning Ordinance and Subdivision Ordinance are being followed. Major Planned Unit Development Amendments are a legislative decision because of the Code deviations being requested. Legislative decisions give the Planning Commission more latitude, but consideration should be given to the PUD standards of previously approved developments in the City as well as the PUD standards of the other similar neighborhoods. The proposed amendment is consistent with other previously approved developments such as Prestwick Place 18th Addition. That development was approved in 2019 and has townhome buildings with up to 8 dwellings units per building. The applicant is asking for the same deviation from the code. General Subdivision Design The preliminary plat area is located on the eastern edge of the Amber Fields development area. It is located directly to the west of Akron Avenue, but it will not have direct access to Akron Avenue. The preliminary plat area will be accessed from a single private road (Road A) to the south of the to-be- constructed 148th Street west. Road A provides access to two private streets that provide an interior loop of the townhome area. The loop street consists of three roads which are Roads B, C and D. A fourth private street, Road E, extends through the central area of the plat between the loop street. The four streets have twenty-one intersecting driveways and a fifth private road, Road F, provides a secondary access to the area from the adjacent parcel to the west. There will be a mixture of 6-unit townhome buildings and 8-unit townhome buildings throughout the development area. The layout of the preliminary plat is generally consistent with what was included in the Master Development Plan. Land Use and Zoning The site is designated for MUR-Mixed Use Residential land uses, which can include a range of housing types from single-family homes on traditional sixty-five foot lots to townhomes. The zoning district in which the preliminary plat is located in the R3-Medium Density Residential district. The proposed 3rd addition has a density of 10.56 units per acre, which the R3 zoning district allows for up to 12 units per acre. The Amber Fields Planned Unit Development Agreement includes several deviations from the Zoning Ordinance. The majority of the deviations are for single-family detached home lot standards, which do not pertain to single-family attached dwellings and townhome standards. The applicant is requesting an amendment to the PUD to increase the maximum allowed dwelling units attached per building, which the proposed standards can be found in the Amendment to the Amber Fields Planned Unit Development Agreement section. Phasing The applicant has provided a phasing plan that shows development initially occurring in the northern portion of the preliminary plat. This area contains 68 out of the 182 townhome units and 9 out of the 24 buildings that will be constructed on site. 7 of the 9 buildings of phase one will contain 8 units per building and the remaining 2 buildings will contain 6 units per building. The access road to 148th Street West and the northern portion of the private roads will be constructed with this first phase. The second phase will consist of the remaining private roads and as well as the road that will provide access to the future development to the west. Amendment to the Amber Fields Planned Unit Development Agreement The Amber Fields Planned Unit Development agreement included several deviations from the Code, most 4 of the deviations are related to the single-family detached lot areas of the development. The applicant is requesting a deviation from the single-family attached dwelling and townhome requirements within the City’s Code. Currently, single-family attached dwellings that are not adjacent to RR-Rural Residential, R-1- Low Density Residential, and R-1A- Low Density Residential are allowed up to a maximum of six (6) dwelling units per building but are only allowed up to a maximum of four (4) dwelling units per building if adjacent to those zoning districts. The applicant is requesting to deviate from a maximum of four (4) dwelling units per building to eight (8) dwelling units per building. The preliminary plat meets all the other dimensional standards of the Amber Fields Planned Unit Development Agreement. Standard Requirement Proposed Standard Maximum Units Per Building 6 dwellings units per building, 4 dwelling units per building if adjacent to RR, R-1, R-1A zoning districts 8 dwelling units per building Streets and Parking There is one access point into the preliminary plat area with that access into the site coming from a connection of Road A with 148th Street West. Road A is the private street entrance into the site and provides access to two private streets that loop within the townhome area. The loop street consists of three roads as identified as Roads B, C, and D. Road E extends through the central area of the development between the loop streets. These four streets have twenty-one intersecting driveways with a fifth private Road, Road F, providing access to the future neighboring development to the west. Akron Ave extends along the east side of this addition and no street or trail connections are planned from Akron Avenue. There are no pedestrian facilities planned for this addition of Amber Fields. A multi-purpose trail extends along the south side of 148th Street West and a trail is identified to extend along the west side of Akron Avenue. A pedestrian trail is planned to extend adjacent to the south side of this subdivision within the central greenway park proposed within Amber Fields. Prior to City Council review there were a total of 782 parking stalls proposed to be provided throughout the subdivision. 364 garage stalls, 364 driveway stalls, and 54 guest stalls. The driveway and garage stall numbers met the City’s requirement, but the guest stall parking did not meet the required minimum. To meet the required guest/overflow parking amount there would need to be 91 parking spots so and additional 37 parking spots were needed to be added throughout the site. The applicant submitted updated preliminary plat information which included the additional 37 parking spots throughout the subdivision. Parks The Parks and Recreation staff has reviewed the park dedication requirement for Amber Fields Third Addition as part of the overall Master Development Plan in order to take into account the multiple playgrounds and extensive open space within the development. Therefore, there is no park dedication requirement for this specific phase of Amber Fields. Currently there are no pedestrian facilities identified within this addition, but a condition within the engineering’s memo states that a pedestrian access to the adjacent trails towards UMore Park will need to be included in the site plan. Tree Preservation and Landscaping A tree inventory was conducted for the overall Amber Fields development area, and a total of 1,983 caliper inches of trees were identified for replacement following the formula laid out in the City Code. The initial 5 phase of construction, which includes 148th Street West and the extension of Auburn Avenue to it, includes 325 caliper inches of trees as mitigation. A total of 1,573 caliper inches of trees will be provided as replacement in this phase and as well as future phases of Amber Fields. Already over 20% of the required replacement trees have been accounted for and staff is confident the remainder will be made up as development continues. The landscape plan submitted by the applicant shows a total of 190 trees to be planted throughout the 3rd addition. The City Code requires for multi-family/townhome developments a minimum of 8 trees plus one tree per unit, which the landscape plan that was submitted conforms with those requirements. A total of 190 trees will be planted with this development, therefore a landscaping surety in the amount of $62,700 (190 trees x $300 plus 10%) is required as a condition of approval. Utilities The site is served by sanitary sewer located within 148th Street West. The sanitary sewer system extends within Road A to the site and provides service to the entire subdivision. Trunk sanitary sewer is identified to be extended within Akron Avenue along the east side of this addition. The sanitary sewer within Akron Avenue must be installed prior to development of this subdivision. Water will be provided to the site via an 8” main within Road F for looping of the system to the west. An additional 8” watermain stub will need to be extended to Akron Avenue for looping to the east. Stormwater is managed across the entire site with detention and retention ponds located in the central open area of Amber Fields. Engineering Review The City’s engineer has provided a memorandum containing comments related to the plans provided. Notable comments include: the private Road F must extend into the adjacent parcel as a private road to a public street, outlots A, B, C, D, E & F must have a drainage and utility easement dedicated over them, and pedestrian access to the adjacent trails and towards UMore Park needs to be included in the site plan. The engineer’s memo is included with the attachments. Final Plat The final plat contains the residential parcels of the first phase of development and dedicated right of way. In the first phase 68 of the 182 townhome lots will be constructed. Additionally, the final plat contains five outlots. Outlot A encompasses all of phase two of the project, which will consist of the remaining 114 townhome lots within he development. Outlot B contains the private streets within the first phase of development. Outlots C, D, and E are the common ground areas adjacent to the townhome development. The final plat is consistent with the preliminary plat provided by the applicant. RECOMMENDATION The Planning Commission and staff are recommending approval of the preliminary and final plats and the major amendment to the Amber Fields planned unit development agreement, subject to conditions in the recommended action and contained within the engineer’s memorandum dated May 11, 2022. This recommendation is based on information provided by the applicant and reviewed in this report. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2022 - A RESOLUTION APPROVING THE PRELIMINARY PLAT AND FINAL PLAT FOR AMBER FIELDS THIRD ADDITION WHEREAS, the City of Rosemount received a request for Preliminary Plat and Final Plat approval from Maplewood Development, concerning property legally described as: Outlot L, AMBER FIELDS, Dakota County, Minnesota WHEREAS, on May 24, 2022, the Planning Commission of the City of Rosemount held a public hearing and reviewed the Preliminary and Final Plats for Amber Fields 3rd Addition; and WHEREAS, on May 24, 2022 the Planning Commission recommended approval of the Preliminary Plat and Final Plat for Amber Fields Third Addition, subject to conditions; and WHEREAS, on June 21, 2022, the City Council of the City of Rosemount reviewed the Planning Commission’s recommendations. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Preliminary Plat and Final Plat for Amber Fields Third Addition, subject to the following conditions: a. Execution of a subdivision agreement. b. Chair Kenninger clarified if part of this property would require only four dwelling units, because it is located next to R1-Low Density Residential. Hogan stated that it is okay to have the 6 dwelling units. Kenninger inquired if side - walks will be apart of the plan. Hogan stated that the developer will need to include a trail or side-walk in their site plan review. Kenninger question if there will be additional guest parking spots. Hogan stated that prior to City Council approval, the applicant will have to show where the additional parking will be located. Commissioner Reed inquired if there will be street parking. Hogan stated that there will not be, provided will be 364 garage stalls and driveway stalls. Nemcek stated that there will be as much parking available as possibl e throughout the development. The outlot is proposed to be replatted into182 townhouse lots and 6 Outlots. Amber Fields Third Addition is located on the easterly side of the Amber Fields Addition extending from 148th Street and adjacent to the west side of Akron Avenue and directly across Akron Avenue from the Umore Ballfields. The plans submitted were prepared by Alliant Engineering. Review comments were generated from the Preliminary Plat Submittal dated 04-29-2022. Amber Fields is a portion of the UMORE Property located between the southerly extension of Auburn Avenue and Akron Avenue, south of CSAH 42. The parent parcel consists of land previously utilized for agricultural purposes and grass land. Amber Fields Third Addition is 17.23 acres. Road A is the private street entrance providing access to two private streets that provide an interior loop of the townhouse area. The loop street consists of three roads as identified on the submittal, Road B, Road C, and Road D. A fourth private street, Road E extends through the central area of the plat between the loop street. These four streets have 21 intersecting driveways and a fifth private street, Road F, that extends west from Road B to the westerly plat border. The private street, Road F, provides a secondary access to the area from the adjacent parcel. Road F must be extended as a private street terminating at a public street. Akron Avenue extends along the east side of the Amber Fields Third Addition. No street or trail connections are identified from Akron Avenue to Amber Fields Third Addition, nor is Akron Avenue identified to be constructed. There are no local public streets proposed in Amber Fields Third Addition There are no pedestrian facilities identified within the Third Addition. A multi-purpose trail extends along the south side of 148th Street and a trial is identified to extend along the west side of Akron Avenue. A pedestrian trail is identified to extend adjacent to the south side of Amber Fields Third Addition within the central greenway park proposed with Amber Fields. There are no trail connections identified from the Third Addition to the adjacent trails. Six Outlots are identified in the preliminary plat of Amber Fields Third Addition, Outlot A, B, C, E, & F are the common ground areas adjacent to the townhouse development and will be owned and maintained by the homeowner’s association, Outlot D contains the private streets and driveways of the Third Addition. All Outlots will be owned and maintained by the development’s Homeowners Association. Phase 1 development of Amber Hills Third Addition consists of the primary access, Road A, extending from 148th Street, Road C, and a portion of Roads B and D. Nine driveways extend from these streets providing access to 54 townhouse units. 1. The private Road F must extend into the adjacent parcel as a private road to a public street. This street extension will be maintained by Amber Fields Third Addition Homeowners Association. 2. Outlots A, B, C, D, E, & F must have a drainage and utility easement dedicated over the outlot. 3. Pedestrian access to the adjacent trails and towards Umore Park needs to be include in the site plan. 4. The typical section for the private streets indicates Right of Way (ROW). For clarity purposes, remove “ROW” from the typical section and identify the street width in the title, ie 24 foot or 26 foot wide. The development Fees are indicated below based on the 2022 Schedule of Rates and Fees. ▪ Sanitary Sewer Trunk Charge: $1,075/acre ▪ Watermain Trunk Charge: $6,500/acre ▪ Storm Sewer Trunk Charge: $6,865/acre GRADING AND DRAINAGE The entire preliminary plat has its runoff directed to the south to Pond 3 located in Amber Fields Central Greenway area. The emergency overflow elevation identified in the southeast corner of Block 23 must be reset to accommodate the proposed elevations for Block 23 and 24. 6. Show existing contours adjacent to the plat for 200 feet beyond the plat boundary. SANITARY SEWER AND WATERMAIN – UTILITY PLAN Amber Fields Third Addition sanitary sewer system extends within Road A from the sanitary sewer in 148th Street. This sewer extension provides service to the entire subdivision. The sanitary sewer system extends within each of the Roads and each of the Driveways identified on the plan. Trunk sanitary sewer is identified to be extended within Akron Avenue along the east side of Amber Fields 3rd Addition. This sanitary sewer is deep requiring a large area for installation. The sanitary sewer within Akron Avenue must be installed prior to development of Amber Fields 3rd Addition. Eight-inch watermain is identified to be extended within the streets and driveways. Each driveway has a watermain stub that terminates at the end of the driveway. The watermain stubs must be looped or a flushing hydrant installed at the end of each driveway. An eight-inch watermain is stubbed to the subdivision boundary within Road F for looping of the system to the west. An additional 8 inch watermain stub needs to be extended to Akron Avenue for looping to the east. Gate valve and fire hydrant placement will be detail reviewed with the construction plans for the subdivision. 7. Trunk sanitary sewer extension must be completed before development of Amber Fields 3rd Addition. 8. Watermain stubs within driveways must be looped. 9. Watermain stub needs to extend to Akron Avenue for looping purposes. STORM SEWER Storm sewer design and layout will be reviewed with the Surface Water Management submittal which was submitted on 04-29-2022. 10. Detail review of the storm sewer system and design will be completed with the construction plans for the subdivisio n. SURFACE WATER MANAGEMENT The proposed Surface Water Management plan for the preliminary plat is currently being reviewed. Comments included in the Surface Water Management review shall be incorporated in the project design. LANDSCAPE PLAN The Landscape plan was reviewed for conflicts with infrastructure. Tree plantings should allow space for access and maintenance of proposed infrastructure. General Infrastructure design shall be completed in accordance with the City of Rosemount’s Engineering Guidelines and Standards. Infrastructure construction shall be completed in accordance with the latest edition of the City’s General Specifications and Standard Detail Plates for Street and Utility Construction.
