On August 8, 2002 SKB Rosemount Industrial Waste Facility accepted three loads of sandblast waste from
Flint Hills Resources under profile M195 -0171 in compliance with the approved waste acceptance plan. On
August 13, 2002 Flint Hills Resources notified SKB that they had shipped one Toad of sandblast waste to
SKB Rosemount in error. The waste did not conform to the approved waste stream. The load was shipped
August 8, 2002 on manifest 84465 and contained 8.77 tons of waste. According to Flint Hills, their quality
control sampling indicated the load had TCLP chromium levels of 8.6 ppm, above the approved limit of 5.0
ppm. Upon receiving this information, SKB notified the Minnesota Pollution Control Agency (MPCA) and
Dakota County of the situation. The area of the landfill containing the load was identified and cordoned otT
to prevent more waste from being placed there.
Additional testing has confirmed the waste was over 5.0 ppm chromium by TCLP. Speciation testing
indicated the waste is approximately fifty percent trivalent and fifty percent hexavalent chromium. Based
on these results, SKB believes the waste is not an immediate threat to the environment. However, the
waste does not conform to the approved waste profile. The onginal sample used for approval only
contained 0.3 ppm chromium. SKB and Flint Hills Resources concur that the material needs to be removed
from the landfill as soon as possible.
Flint Hills Resources has agreed to remove the waste. However, due to the fact the landfill contains
asbestos waste, proper monitoring will be required to remove the waste. Approval for disposal of the
material at another landfill is also necessary. We expect to have everything in place to remove the material
either Thursday, August 29 or Tuesday, September 3.
