ATTACHMENTS: Resolution; Excerpt from the August 23, 2022 Planning Commission Meeting APPROVED BY: LJM Minutes; Site Location; Site Survey; Plat; Future Road Alignment RECOMMENDED ACTION: Motion to adopt a resolution approving a minor subdivision for Rich Valley Industrial Park Second Addition, subject to the dedication of Right of Way for a future east-west road prior to Council approval of any development on the southern portion of the Rich Valley plat. BACKGROUND The applicant is the developer of the former Rich Valley Golf Course site for the future FedEx warehouse and distribution facility. A condition of approval of that project was the inclusion of an east/west road to connect Conley Avenue with the future Driver Avenue which will be located along the eastern boundary th of the former golf course that would connect County Road 42 and 140 Street East. The east/west road is required due to the planned removal of the connection of Conley Avenue to County Road 42 that will occur when the 42/52 interchange is reconstructed. Because an outlot of the Rich Valley Industrial Park plat separates the golf course site from Conley Avenue, and the applicant did not wish to acquire the entire outlot, a minor subdivision is necessary to split off the portion of the outlot the applicant is acquiring. The applicant will dedicate right of way for the future road at a later date. Because one existing outlot is proposed to be split into two new outlots, the typical review of lot standards within the zoning ordinance is not required as it would be if a new buildable lot was being created. PLANNING COMMISSION ACTION The Planning Commission reviewed the request and held a public hearing during its meeting on August 23, 2022. No public comments were received by the Commission related to this request. The Planning Commission voted unanimously to recommend approval of the minor subdivision. RECOMMENDATION The Planning Commission and Staff are recommending approval of the Minor Subdivision to create two nd outlots in the Rich Valley Industrial Park 2 Addition. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2022-114 A RESOLUTION APPROVING A MINOR SUBDIVISION TO CREATE RICH VALLEY INDUSTRIAL PARK SECOND ADDITION. WHEREAS, the City of Rosemount is initiating the request for a minor subdivision, concerning property legally described as: Outlot A, RICH VALLEY INDUSTRIAL PARK, according to the recorded plat thereof. WHEREAS, the Minor Subdivision approval will create two parcels legally described as: Outlot A, RICH VALLEY SECOND ADDITION, according to the recorded plat thereof. And Outlot B, RICH VALLEY SECOND ADDITION, according to the recorded plat thereof. WHEREAS, on August 23, 2022, the Planning Commission of the City of Rosemount held a public hearing and reviewed the request; and WHEREAS, on August 23, 2022, the Planning Commission recommended approval of the requested applications, subject to conditions; and WHEREAS, on September 6, 2022, the City Council of the City of Rosemount reviewed the Planning Commission’s recommendations. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Minor Subdivision. The public hearing opened at 6:36 pm. Public Comments: None. MOTION by Kenninger to close the public hearing. Second by Reed. Ayes: 5. Nays: 0. Motion Passes. The public hearing closed at 6:37 pm. Additional Comments: None. MOTION by Rivera to recommend the City Council approve a Minor Subdivision for Rich Valley 2nd Addition, subject to the dedication of Right-of-Way for a future east-west road prior to City Council approval of any development on the southern portion of the Rich Valley plat.
