ATTACHMENTS: Resolution APPROVED BY: LJM RECOMMENDED ACTION: Motion to approve the Resolution accepting Tammy Block’s resignation from City Council and declaring a vacancy BACKGROUND Councilmember Tammy Block resigned from City Council on September 6, 2022 effective immediately. Per Minn. Stat. 351.01, the resignation must be in writing and received by the City Council for the resignation to be effective. Tammy’s term was to end on December 31, 2022. Councilmember Block will remain a candidate on the ballot for the 2022 Election because the withdrawal by date has passed. To effectively withdrawal as a candidate, Councilmember Block needed to submit an affidavit by 5pm two days after the filing deadline for candidacy. Staff will discuss a procedure and timeline to fill the vacancy after the November 8th election. RECOMMENDATION Staff recommends the Council approve the resignation accepting Tammy Block’s resignation from City Council and declaring a vacancy. CITY OF ROSEMOUNT DAKOTA COUNTY STATE OF MINNESOTA RESOLUTION NO. 2022 - XX A RESOLUTION ACCEPTING COUNCIL MEMBER BLOCK’S RESIGNATION FROM OFFICE AND DECLARING THAT A VACANCY EXISTS ON THE ROSEMOUNT CITY COUNCIL TO BE FILLED BY APPOINTMENT WHEREAS, Tamara Block was elected to the office of City Council for the City of Rosemount for a term commencing on January 7, 2019 and terminating on January 2, 2023; and WHEREAS, Tamara Block submitted her resignation in writing to the City Administrator on September 6, 2022; and WHEREAS, the City Council must determine and declare whether or not a vacancy exists on the City Council; and WHEREAS, Minnesota Statutes, section 412.02, subd. 2a. states that when a vacancy in an elected office of a city occurs with less than two years remaining in the unexpired term of the office, the City Council must appoint someone to complete the balance of the unexpired term and until the qualification of a successor; and WHEREAS, less than two years remain in Council Member Block’s unexpired term. NOW THEREFORE BE IT RESOLVED by the Rosemount City Council as follows: 1. The City Council accepts the resignation of Council Member Block and declares that a vacancy exists on the Rosemount City Council as of September 20, 2022. 2. The City Council will act to fill the vacancy by appointment in accordance with Minnesota Statutes, section 412.02, subdivision 2a.
