ATTACHMENTS: Resolution; Easement Vacation Sketch APPROVED BY: LJM RECOMMENDED ACTION: Motion to adopt a resolution vacating the drainage and utility easement along the west line of Lot 1, Block 1, Rosemount Car Club BACKGROUND The City Council is being asked to consider a request by Pineridge Hillside, LLC to vacate a drainage and utility easement located along the western boundary of the parcel legally described as Lot 1, Block 1, Rosemount Car Club. The City Council approved a Planned Unit Development Master Development Plan and Conditional Use Permit for the applicant to construct a three-building condominium garage facility on the site, and the existing easement must be vacated to accommodate the development. New easements as required by the City Engineer will be dedicated on the site, and the dedication of said easements is included as a condition of approval in the attached resolution. RECOMMENDATION Staff recommends the Council approve the vacation of the easement, subject to the dedication of easements as required by the City’s engineer. CITY OF ROSEMOUNT DAKOTA COUNTY, MINNESOTA RESOLUTION 2022-XX A RESOLUTION APPROVING THE VACATION OF THE BLANKET DRAINAGE AND UTILITY EASEMENT OVER OUTLOT A AND B, ARDAN PLACE FIRST ADDITION WHEREAS, the City of Rosemount received an application from Pineridge Hillside, LLC. (Applicant) for approval of a Conditional Use Permit and a Planned Unit Development Master Development Plan to construct a condominium garage facility; WHEREAS, on September 20, 2022, the City of Rosemount City Council reviewed and approved the Conditional Use Permit and a Planned Unit Development Master Development Plan; and WHEREAS, the vacation of the existing drainage and utility easement legally described below is required for development of the condominium garage facility; and WHEREAS, the City Council reviewed this request and conducted a public hearing on October 4, 2022. NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the Vacation of the Drainage and Utility Easement, legally described as: The drainage and utility easement along the west line of Lot 1, Block 1, Rosemount Car Club, Dakota County, Minnesota, according to the recorded plat thereof. Subject to the dedication of a drainage and utility easement as required by the City’s engineer. ADOPTED this 4th day of October 2022, by the City Council of the City of Rosemount. __________________________________________ William H.
