RECOMMENDED ACTION: Motion to adopt a resolution approving the vacation of the
drainage and utility easements over portions of Outlots J, K and I, Amber Fields.
BACKGROUND
The City Council is being asked to consider a request by Maplewood Development to vacate existing
drainage and utility easements over portions of Outlots J, K and I within the Amber Fields
Development in order to facilitate development of Amber Fields 2nd, 4th and 5th Additions. This action
is typical when there are multi-phased developments in a larger preliminary plat.
Appropriate new drainage and utility easements will be recorded with Amber Fields 2nd Addition,
which was approved by Council at its May 17th, 2022 meeting, and will be recorded with Amber Fields
4th and 5th Addition final plats, which were approved by Council at its July 19th, 2022 meeting. The
delay between the vacation of the drainage and utility easements and the original plat approvals were
due to an oversight that was noticed by the applicant and staff. The final plat for Amber Fields Second
Addition has been recorded with Dakota County, and all required drainage and utility easements were
dedicated in that plat.
RECOMMENDATION
Staff recommends the City Council approve the vacation of the drainage and utility easements over
portions of Outlots J, K and I, Amber Fields.

RESOLUTION 2022-XX
A RESOLUTION APPROVING THE VACATION OF THE DRAINAGE AND UTILITY
EASEMENTS WITHIN OUTLOTS J, K AND I, AMBER FIELDS
WHEREAS, the City of Rosemount received an application from Maplewood Development (Applicant)
for the vacation drainage and utility easements within portions of Outlots J, K, and I, Amber Fields.
WHEREAS, the vacation of the existing drainage and utility easements legally described below is required
for development of Outlots J, K and I, Amber Fields; and
WHEREAS, the City Council reviewed this request and conducted a public hearing on October 4, 2022.
NOW, THEREFORE, BE IT RESOLVED, the Council of the City of Rosemount hereby approves the
Vacation of the Drainage and Utility Easements, legally described as:
Vacating those drainage and utility easements embraced within Outlot J, AMBER FIELDS, as
dedicated on the recorded plat thereof, Dakota County, Minnesota, recorded as Document Number
3538193.
And
Vacating those drainage and utility easements embraced within Outlot K, AMBER FIELDS, as
dedicated on the recorded plat thereof, Dakota County, Minnesota, recorded as Document Number
3538193.
And
Vacating the drainage and utility easement embraced within Outlot I, AMBER FIELDS, as
dedicated on the recorded plat thereof, Dakota County, Minnesota, recorded as Document Number
3538193.
ADOPTED this 4th day of October 2022, by the City Council of the City of Rosemount.
