Default Remedy Corrective Actions
BACKGROUND
On September 20, 2022, City Council awarded this work to Hoffman & McNamara, Co. in the amount of
$85,769. Since the award, the contractor has completed this work and improvements are installed as per
the contract. WSB and Associates has reviewed the work and is coordinating receipt of final
administrative requirements to include IC-134s, lien waivers and consent of surety.
RECOMMENDATION
Staff recommends that City Council adopt the resolution accepting the improvements and issuing final
payment pending receipt of all administrative paperwork.

RESOLUTION ACCEPTING DUNMORE 1ST AND 2ND ADDITIONS
DEFAULT REMEMDY CORRECTIVE ACTIONS
WHEREAS, the Hoffman & McNamara, Co. has completed the corrective actions, and;
WHEREAS, the City received a letter from WSB & Associates, Inc. confirming this work in
accordance with the approved contract and finds the work acceptable, and;
WHEREAS, the developer is preparing final close out documents to include proof of withholding, lien
waivers, and consent of surety.
BE IT RESOLVED, by the City Council of the City of Rosemount, Minnesota. The work completed
under said agreement is hereby accepted and final payment is authorized contingent upon receipt of the
above-mentioned documents.
ADOPTED this 15th day of November, 2022.

Dear Mr. Erickson:
Pay Voucher No. 1 (Final) for the above referenced project in the amount of $85,169.00 is
enclosed. The quantities completed to date have been reviewed and agreed upon by the
contractor. We hereby recommend that the City of Rosemount approve the Final Construction
Pay Voucher for Hoffman & McNamara Co.
The Contractor is preparing the following required documents:
1. Satisfactory showing that the contractor has complied with the provisions of
Minnesota Statutes 290.92 requiring withholding state income tax (IC134 forms).
2. Evidence in the form of an affidavit that all claims against the contractor by
reasons of the contract have been fully paid or satisfactorily secured (lien
waivers).
3. Consent of Surety to Final Payment certification from the contractor’s surety.
4. Two-year maintenance bond.
Once these documents have been received, please include one executed copy of the pay
voucher with the payment to Hoffman & McNamara Co. and return one executed copy to our
