BACKGROUND:
CITY COUNCIL
EXECUTIVE SUMMARY
On October 4, 2005, the Rosemount City Council received a petition from residents along 132nd Court
West requesting City sanitary sewer and water service. Since greater than 35 of the impacted residents
requested the improvements, a simple majority council vote authorized the preparation of a Feasibility
Report for the 132nd Court Improvements Project This project has been designated as City Project No.
393.
1. Location
The project is located on 132nd Court West in the north central portion of the City, and is north of Old
County Road 38 and west of Trunk Highway 3.
2. Proposed Street Improvements
With the reconstruction and upgrade of Old County Road 38 (City Project 387), it is proposed that 132nd
Court West be paved as a rural section, maintaining the existing ditches and drainage patterns. Curb and
gutter will not be installed as a part of this project Bituminous pavement is recommended to reduce the
trackmg of gravel onto Old County Road 38, as well as protect the existence of utilities placed under the
road.
3. Sanitary Sewer
It is proposed that a new 21 inch trunk sanitary sewer would be installed along the west leg of 132nd
Court where it can be extended to the north in the future to service areas north of Old County Road 38.
An 8 -inch lateral PVC sanitary sewer will be installed along the remauung portions of 132nd Court The
sanitary sewer will connect to new sanitary sewer being installed as part of the Old County Road 38 project
(City Project 387).
4. Water Main
It is proposed that a new 8 -inch ductile iron pipe (DIP) watermain be installed with the sanitary sewer
along 132nd Court West

5. Funding
The total estimated project cost is $216,900, which includes a 5% contingency and 30% indirect costs
Funding for the project will consist of special assessments, 2006 Street Capital Improvement Plan (CIP)
funds, and Samtary Sewer Uuhty funds
Properties with front footage or accessible acreage along 132n Court West are proposed to be assessed on
a per unit basis for surface, sanitary sewer, and water main improvements
According to the City of Rosemount's 2006 Fee Resolution, the cost of street reconstruction of existing
gravel roads is to be assessed to benefiting properties at a rate of 100% of the total cost. To determine the
street assessments, the total cost for street improvements was divided by the properties within 132n Court
West Street assessments are estimated at $6,657 per unit, and are levied against all properties with
driveway access onto 132n Court West.
The total cost for new lateral sanitary sewer and watermam are to be borne by the benefiting properties.
Each property is proposed to be assessed an equal amount for sanitary sewer and watermain
improvements. The estimated sanitary sewer assessment is $5,345 per property. The estimated watermam
assessment is $4,055 per property.
The total funds proposed to be recovered through assessments for this project is $183,300 The City
Sanitary Sewer Utility Fund and the City Street CIP Fund will fund the remaining portion of the project.
It is proposed that construction occur in 2006 and rs anticipated to be completed, including all restoration
items, by the fall of 2006.
SUMMARY:
Staff is requesting that the City Council adopt the attached resolution ordering the project and authorizing
the preparation of plans and specifications for City Project 393

WHEREAS, the City Council has received and accepted the Feasibility Report on January 17, 2006 for City
Project #393, and
WHEREAS, the City Council held a Public Hearing on February 7, 2006.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Rosemount hereby orders the
improvements of the 132nd Court West Street and Utility Improvements City Project #393.
BE IT FURTHER RESOLVED, that the City Council of the City of Rosemount orders the preparation of
plans and specifications for said unprovements of City Project No 393
ADOPTED this 7th day of February, 2006.

This correspondence is in addition to the notice of public hearmg being mailed to you that is
scheduled for February 7, 2006 for the 132n Count West Street Utility Improvements,
City Project No. 393. You are receiving this notice because your property is within the
proposed project area
As part of the City's ongoing pavement management program, a feasibility report has been
prepared for improvements proposed to be completed in 2006 The proposed improvements
include installation of approximately 400 feet of 21 -inch PVC trunk sanitary sewer,
approximately 300 feet of S -inch PVC sewer and 8" ductile iron pipe (DIP) water main Service
lines will be extended to individual properties, where property owners may connect at a future

The feasibility report will be presented at the regular City Council meeting on February 7, 2006
The presentation will include an overview of the proposed improvements, estimated costs and
assessments proposed to be charged to property owners for the project.
The pubhc hearing is an opportunity for property owners to address the City Council regarding
the proposed project

This letter is in opposition of the City project #393 and also a follow up from the letter to the City
Engineer dated August 26, 2005
Before the city reaches a decision, written information as to existing wells, septic systems, inside
plumming and all other involved expenses should be given to home owners by the city and not the
responsibility of the home owner to research
The meeting on January 4, 2006 provided information to the home owners on the proposed project
showing 50% m favor and 50% against the project. This information seemed to be gathered by the
residents living on 132nd Ct W The gathering of information from the residents w as improperly
handled by the City Engineer. Each home owner should has e been sent a project outline from the city
asking the owners opinion for or against the project. As this was not done, a divided neighborhood thus
sent their own petition picking residents who they thought could be convinced Some owners were not
reached to has a written opportunity on the petitions
The letter written August 26 2005 (copy enclosed), stated two residents out of compliance. Now the city
has the authonty to burden those who have updated their septic system and wells Several home owners
are retired and living on fixed incomes Is it fair to put these home owners in a financial cnsis because of
two home owners? The answer is NO.
The city has done little to lower the cost of the project only to offer low interest rates. This does not
change the cost of the project. Maybe it will benefit future des elopers or the project on the Brockway
land We were also told at the Janurary 4th meeting if the project is completed, 132nd Ct. W. could be
rezoned When asked by residents, if this would raise our taxes, the answer was, It could Where does
it end to burden residents who do not want or need the project' The assesment cost is extremely high
along with the required fees There is no guarantee of the estimated cost of the project, there is no cap on
the assesment charges This project will not improve our property

This is a follow up from the meeting August 17, 2005 at City Hall.
Several people were interested in the proposal and the cost. The figures are very
costly and staggering. 'rhe total cost of the project could rouge between 522,000-
S30,000 per resident. We have two residents out of compliance while the other
residents are in compliance, thus making the project not necessary to proceed. The
two residence that are not in compliance can be brought up to compliance with
many dollars saved by them and other residence who are compliant. L%{any of the
residence have spent many dollars already to stay compliant as, should the two
residence who are out of compliance.
Resident at 2655 has a mound system that will last indefinite. Due to great
friendship, teaming with the resident at 2625 who is not in compliance, are now
canvasing for the sewer. Yes, even cities have problems with sewer lines. Ha\ ing
city sewer and water does not make for a perfect system for ever. We still t, ant to
drink our water which is much better tasting than city treated water. Allowing or.!y
for out side use of our current welts is not a fair practice regardless of the reasons
given by the city. If a petition once again is brought to the residence, this should be
generated by the city and not just a few residences of 132nd 0. W. This project
has divided the longevity of a stable neighborhood. At an earlier meeting, we were
told residence on Cty. Rd 38, had to hook up and now at the last meeting told they
could vote. What is it? Too many variables and questions !eft unanswered.
It is in the best interest of the residents of 132nd Ct. W to eliminate this project and
have the non compliant systems updated like the remainder of the court has already
done.

As we will not be able to attend this meeting, Aim sending this letter to express our opinion on this matter.
We have no objections to what is being proposed and to the feasibility report Our objection is to the price
that is being forced upon us to take care of the problems of two of our neighbors. We have lived at our
present address for 35 years and just received our latest compliance letter from the city for our septic system
and in 2002 we had new well installed. I might add we did not go to the city to have the whole
neighborhood put in waterlines.
I feel that there should be some relief for Senior citizens in this case. My husband has been retired for 15
years due to a medical problem and I have been retired for 10 years. If this had been forced upon us in our
early years of retirement it would have been easier to justify spending the money. We have intended this to
be our final retirement home, but with a rise in our property tax of 16.6% this year and the rising cost of
health insurance which is a must with heart disease it will be putting us in a bind that one does not need at
this stage of life.
We feel the city should offer some kind of alternate plan for Seniors. If it was not for the Seniors in
Rosemount there would not be a Rosemount. Stop and think about that!
