RECOMMENDED ACTION: Motion to approve an Off -Sale L quor License for MGM Wine
Spirits, Inc. to be located at 14865 South Robert Trail to be effective July 1, 2006 and is
contingent upon a successful background investigation of a named manager for the site.

EXECUTIVE SUMMARY
ISSUE
An off -sale liquor license has been applied for by MGM Wine Spmts, Inc. for a store to be located at
14865 South Robert Trail m the Rosemount Crossings shopping center.
SUMMARY
MGM Wme Spirits, Inc. has proposed to open an off -sale liquor store at 14865 South Robert Trail.
This store is located adjacent to the Anytime Fitness m the northern section of the strip mall at
Rosemount Crossings. There is approximately 5090 square feet of space at the proposed site
MGM Wine Spmts, Inc. has completed the required applications A background investigation was
conducted by Pohce Department staff The applicant has an interest m eighteen (18) other off -sale liquor
stores located in the Twin Cities metropolitan area. There have been a total of five (5) violations at the
stores and the five violations occurred at only three of the stores Since 2002, there have not been any
violations at any of the eighteen stores MGM Wme Spirits has an interest in. The applicants do not
have criminal records.
The issuance of this license would not occur until July 1, 2006 in accordance with City Code 3 -1, which
limits the number of off -sale licenses until July 1, 2006. Also, a manager of the store must be named and a
background investigation of the manager completed prior to issuance of the license
Staff recommends approval of this off -sale liquor license with the conditions included within the proposed
motion
