RECOMMENDED ACTION:
Motion to approve the job descriptions and grade placement for the Updated Building
Inspector/Fire Marshal and New Senior Building Inspector positions.
Motion to authorize the promotion of Jon Phelps to Building Inspector/Fire Marshal effective
January 9, 2023.
Motion to authorize the promotion of John McNeish to Senior Building Inspector effective on
the next work day after his Interim Building Official assignment is completed.
BACKGROUND
As a part of the 2023 budget, funding was included to create a new position and modify the structure
within the Building Inspections Department. With the pace of development in Rosemount, an
additional Building Inspector position was budgeted to begin mid-year. In addition, the creation of a
new Senior Building Inspector position within the Department was envisioned.
At the February 7th work session, Staff discussed potential restructuring of the department to best
meet the growing demands on the department, the needs of the organization, and the impact on
staffing. Budget impacts for 2023 are anticipated to be minimal.
Our previous Building Official/Fire Marshal retired in late 2022. Because of the unique skillset
required in that rare combined position, the position was ultimately posted as the Building Official only
and recruitment is underway. Building Inspector John McNeish was identified as the Interim Building
Official until a replacement can be hired. John has worked for the City for over 22 years and has a
wealth of experience. John’s depth and knowledge base has grown through the years and the
organization leans heavily on him in many areas. Staff recommends that John McNeish be promoted to
Senior Building Inspector once the Interim Building Official assignment is complete.
Jon Phelps was identified as an existing staff member who met the unique skillset, training, and
certification needed to provide the Fire Marshal tasks as well as the Building Inspector position. He
has worked for the City for 4 years and has served as Fire Marshal for a different community earlier in
his career. Jon has continued to excel in his role and his focus areas continue to expand.
The updated Building Inspector/Fire Marshal position and new Senior Building Inspector position
were reviewed utilizing the SAFE Evaluation System to consider the duties of both positions and
determine any potential changes in compensation, grade placement, and pointing.

It is recommended that the Building Inspector/Fire Marshal Position be placed at Grade 16 and the
Senior Building Inspector position be placed at Grade 16 based on the nature and scope of the work,
other position responsibilities within the City, and pay equity data. Based on this data, staff is
proposing that both positions be compensated at the 2023 range of $40.30 – $50.43/hour. The draft
job descriptions are attached.
John and Jon both continue to impact the City in positive and innovative ways, they have excellent
experience and unique skillsets that are needed in these crucial roles. We are excited to see them excel
and assist the team in their new positions.
Both positions fall within the AFSCME contract and representatives of the union have reviewed and
agreed with the proposed changes.
RECOMMENDATION
Staff is recommending the City Council approve the job descriptions and salary ranges for the Building
Inspector/Fire Marshal and Senior Building Inspector positions; and authorize the promotions of Jon
Phelps to Building Inspector/Fire Marshal effective January 9, 2023 and John McNeish to Senior
Building Inspector effective on the next work day after his Interim Building Official assignment is
completed.

General Summary
Performs work conducting building inspections and plan reviews, ensuring compliance with codes and
regulations relating to building, fire, general maintenance of private property, illegal use of facilities, rental,
septic, and zoning, preparing permits, completing and maintaining required reports and records, and
related work as apparent or assigned.
Work is performed under the direction of the Chief Building Official.
Essential Functions
To perform this job successfully, an individual must be able to perform each essential function
satisfactorily. The requirements listed below are not intended to be an exhaustive list of all
responsibilities, duties, and skills required. Reasonable accommodations may be made to

• Travels to and performs on-site inspections on buildings and construction sites; conducts plan
reviews; interprets and ensures compliance with local, state, and federal rules, regulations, codes,
and ordinances.
• Completes paperwork and reports on completed inspections; prepares permits, handouts, forms, and
related paperwork; delivers required reports to the appropriate resource; delivers notifications of non-
compliance and citations.
• Assists architects, builders, contractors, developers, homeowners, engineers, and general public with
codes and inspection related inquiries; answers questions and assists with code compliance
requirements; directs inquiries to the appropriate resource as needed.
• Enforces zoning and subdivision ordinances; assists the Chief Building Official as directed.
• Serves as Fire Marshal for the City; conducts field inspections on structures to ensure compliance
with codes and ordinances and to verify proper fire protection features are in good condition;
responds to complaints and performs related inspections.
• Reviews plans for permitted construction activities; reviews fire appliance installations and conducts
acceptance tests on sprinkler and fire alarm systems; performs fire investigations and completes
required paperwork; assists with fire pre-planning and oversees Knox Box program for the Fire
Department.
• Participates in fire prevention education.
Minimum Qualifications
• High School diploma or GED.
• Minnesota Department of Labor and Industry Building Official Limited certification upon hire.
• Obtain Minnesota Board of Firefighter Training and Education Fire Inspector I and II certification
within one year of hire or International Code Council (ICC) Fire Inspector I and II certifications
upon hire.
• Valid driver's license in the State of Minnesota or ability to obtain within 3 months.

Desirable Qualifications
1. Graduate of a two-year vocational school or equivalent credits. Law enforcement, public
administration, housing, construction trades, planning or related course work preferred.
2. Strong mechanical/plumbing background preferred.
3. Commercial and industrial construction experience.
4. Construction management/supervision.
5. Commercial or residential plan review experience.
6. Advanced certification or training in area related to fire suppression, fire protection, fire inspector, etc.
7. Certified Building Official.
8. State of Minnesota Fire Delegation for Fire Sprinkler Review certifications.
9. Minnesota Pollution Control Agency Subsurface Sewage Treatment Systems (SSTS) certification
upon hire.

Physical Requirements and Activity
This work requires the occasional exertion of up to 25 pounds of force; work occasionally requires standing,
walking, sitting, speaking or hearing, using hands to finger, handle or feel, climbing or balancing, stooping,
kneeling, crouching or crawling, reaching with hands and arms, pushing or pulling and repetitive motions.
Sensory Requirements
Work has standard vision requirements; vocal communication is required for expressing or exchanging
ideas by means of the spoken word; hearing is required to perceive information at normal spoken word
levels.
Sensory Utilization
Work requires preparing and analyzing written or computer data, visual inspection involving small defects
and/or small parts, using of measuring devices, operating motor vehicles or equipment and observing
general surroundings and activities.
Environmental Conditions
Work occasionally requires wet, humid conditions (non-weather), working near moving mechanical parts,
working in high, precarious places, exposure to fumes or airborne particles, exposure to toxic or caustic
chemicals, exposure to outdoor weather conditions, exposure to extreme cold (non-weather), exposure to
extreme heat (non-weather), exposure to the risk of electrical shock, exposure to vibration and exposure to
bloodborne pathogens and may be required to wear specialized personal protective equipment; work is
generally in a very loud noise location (e.g. jack hammer work, garbage recycle plant).

General Summary
Performs experienced-level work conducting building inspections and plan reviews, ensuring compliance
with codes and regulations relating to building, fire, general maintenance of private property, illegal use of
facilities, rental, septic, and zoning, preparing permits, completing and maintaining required reports and
records, and related work as apparent or assigned.
Work is performed under the direction of the Chief Building Official; may provide general work direction to
others within the Building Inspection Department.

• Three years of relevant experience in work and/or inspection experience in residential and
commercial building, HVAC, and plumbing systems.
• Commercial or residential plan review experience.
• Certified Building Official
• Valid driver's license in the State of Minnesota.
