RECOMMENDED ACTION: Motion Approving the Stormwater Maintenance Agreement
BACKGROUND
Attached for City Council review and approval is a Stormwater Maintenance Agreement (Agreement)
between the City of Rosemount, Dakota County and Mosaic Crop Nutrition, LLC. This agreement
provides for shared maintenance costs on the required stormwater ponding.
Dakota County has completed design for the construction of the final segment of the Mississippi River
Greenway. As part of this project, stormwater ponding was constructed along Pine Bend Trail to address
the added impervious from both trail and internal site changes at Mosaic.
As part of the agreement, Dakota County will pay a share of major maintenance costs related to the
ponding. Major maintenance is defined within the agreement and generally consists of removing sediment
from the pond once its function has been substantially impacted. The cost split is 72% Rosemount and
28% County share, and the city agrees to provide a minimum of 1-year written notice prior to any major
maintenance being performed.
Dakota County anticipates that the site modifications on Mosaic will be completed mid-summer of 2023.
These modifications will provide for truck queueing off road and on the Mosaic site, eliminating this
traffic hazard. The trail work and road improvements will likely not begin until 2024 due to very long lead
times for the underpass materials.

Staff recommends City Council approval of the Stormwater Maintenance Agreement.
