Minutes of the April 4, 2023 Regular MeetingROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 4, 2023 CALL TO ORDER Pursuant to due call and notice thereof a regular meeting of the Rosemount City Council was held on Tuesday, April 4, 2023, at 7:00 p.m. in Rosemount Council Chambers 2875 145th Street West. Mayor Weisensel called the meeting to order with Councilmember Essler, Freske, Klimpel and Theisen attending. Staff present included the following; • Community Developmenr Director Kienberger • City Attorney Tietjan • Economic Development Coordinator Van Oss • Stormwater Specialist Byron • Parks & Recreation Director Schultz • Chief of Police Dahlstrom APPROVAL OF AGENDA Motion by Weisensel Second by Freske Motion to Adopt the Agenda Ayes: 5. Nays: None. Motion carried. PRESENTATIONS, PROCLAMATIONS AND ACKNOWELDGEMENTS 3.a. Arbor Day Proclamation Director of Parks & Recreation Schultz provided information about the Arbor Day celebration on April 29th. Mr. Schultz noted several different trees that will be available at the tree giveaway which will take place at the Public Works building. Mayor Weisensel read the proclamation. Motion by Essler Second By Theisen Ayes: Essler, Klimpel,Weisensel, Theisen, Freske Nays: None. Motion carried. 3.b. No Mow May Proclamation Stormwater Specialist Byron presented the “No Mow May” program. The program seeks to create early season habitat and forage for pollinators through suspension of lawn mowing during the month of May, a critical time for pollinators coming out of hibernation when food sources may be scarce. Residents are asked to register for the program. The City would suspend enforcement of lawn height weed ordinance on occupied properties during May. Councilmember Essler suggested providing lawn signs in the future with stakes to promote and create awareness about the program. Mayor’s Water Challenge City Administrator Martin introduced the annual National Mayor’s Water Challenge. The challenge takes place in April and allows residents to make a series of online pledges. Mayor Weisensel proclaimed that the City of Rosemount agrees and supports the “Wyland Mayor’s Challenge for Water Conservation during April 1- 30, 2023. Commissioner Appointments Councilmember Essler pulled this item for futher recognition and stated council’s appreciation for all indivduals who expressed interest. Motion by Essler Second by Theisen Motion to fill Commission vacancies with the following appointments: • James Bonkoski reappoint for a 3-year term on the Parks and Recreation Commission; • John DeBettignies reappoint for a 3-year term on the Parks and Recreation Commission; • Jennifer Edminson for a 3-year term on the Parks and Recreation Commission; • Melissa Kenninger reappoint for a 3-year term on the Planning Commission; • Kurt Whitman appoint for a 3-year term on the Planning Commission; • Tim Beaudette appoint for a 6-year term on the Port Authority; • Vanessa Demuth appoint for a 3-year term on the Utility Commission • Kip Springer appoint for a 3-year term on the Environment & Sustainability Commission; • Kristen Andrews reappoint for a 3-year term on the Environment & Sustainability Commission • Kate Reed for a 1-year term on the Environment & Sustainability Commission (youth seat) Ayes: Theisen, Freske, Essler, Klimpel, Weisensel Nays: None. Motion carried. PUBLIC HEARINGS 7.A. MINNESOTA INVESTMENT FUND (MIF) AND JOB CREATION FUN (JCF) PROGRAM Economic Development Coordinator Van Oss presented how Spectro Alloys has been working with the Minnesota Department of Employment and Economic Development (DEED) to utilize two state funding programs due to Spectro’s expansion of their Rosemount facility. The expansion represents a major investment in the industrial area and will bring 70 new highly paid jobs to Rosemount. The City acts as the local government sponsor of these programs, and to begin the application submittal process must pass resolutions of support for the project. The Minnesota Investment Fund (MIF) Program provides loans to businesses that create or retain high-paying, full-time permanent jobs, and invest in machinery or real property acquisition or improvements. As part of the application to DEED, the City of Rosemount is required to hold a public hearing concerning the submittal of the MIF application to DEED. Additionally, prior to application submittal, the City of Rosemount must adopt a resolution to act as he legal sponsor for the project and to enter into a grant agreement with the State of Minnesota. Mayor Weisensel opened the public hearing at 7:35 p.m. No public comments received. Motion by Weisensel Second by Essler Motion to close the public hearing at 7:35 p.m. Ayes: 5. Nays: None. Motion carried. Motion by Theisen Second by Essler Motion to approve the Minnesota Investment Fund Program application and resolution Ayes: Essler, Klimpel, Weisensel, Theisen, Freske Nays: None. Motion carried. Motion by Theisen Second by Freske Motion to approve the Minnesota Job Creation Fund application and resolution Ayes: Klimpel, Weisensel, Theisen, Freske, Essler Nays: None. Motion carried. ROSEMOUNT CITY COUNCIL REGULAR MEETING PROCEEDINGS APRIL 4, 2023 7.b. Request by Roers Rosemount Apartments, LLC for the vacation of a drainage and utility easement Community Dvelopment Director Kienberger presented the consideration of a request by the developer of a new multi-family building northwest of the intersection of the Akron and County Road 42 for the vacation of a drainage and utility easement that is no longer needed by the City following the removal of a storm sewer stub ahead of construction of the building. Mr. Kienberger noted this is standard procedure and requires a public hearing. Mayor Weisnesel opened the public hearing open at 7:38 p.m. Motion by Weisensel Second by Essler Motion to close the public hearing at 7:38 p.m. Ayes: 5. Nays: None. Motion carried. Motion by Essler Second by Klimpel Motion to adopt a resolution vacating the drainage and utility easement within Lot 1, Block 1, Prestwick Place 24th Addition Ayes: Weisensel, Theisen, Freske, Essler, Klimpel Nays: None. Motion carried. NEW BUSINESS 9.a. Execution of Various Agreements Related to the Life Time Project City Administrator Martin highlighted the latest details of the Life Time Project. The project is currently out for bid and remains on track for an early summer groundbreaking. The City Council is required to authorize the Partial Assignment of the Purchase and Sale Agreement. This action allows the City to assign its ability to purchase the remaining property (i.e. property not occupied by the Club) to Life Time, allowing them to buy the outlot property for their future development efforts. The Lease Agreement establishes the Port Authority’s landlord / tenant relationship with Life Time for the next 30 years. Aaron Kohler, Life Time representative, further discussed the highlights of the partnership and building. Motion by Theisen Second by Freske Motion to authorize the attached Resolution to execute various agreements related to the Life Time project. Staff Updates Chief of Police Dahlstrom informed all of the “Guns & Hoses” Hockey tournament this Saturday. Parks & Recreation Director Schultz informed all of the annual egg hunt that will take place this weekend at the Ames Soccer Complex at DCTC. 10.b. Upcoming Community Calendar Mayor Weisensel reviewed the calendar of events and upcoming meetings.
