RECOMMENDED ACTION: The Rosemount Fire Department would like to formally acknowledge and
honor the retirement of two highly respected members: Firefighter Greg Zeno and Captain Brad Miller.
BACKGROUND
Firefighter Greg Zeno and Captain Brad Miller retired on July 4th, 2025 after 22 years of exemplary
service, having joined the department together in January 2003. Over the past two decades, they have
both been instrumental in building and strengthening the foundation of our department,
demonstrating dedication, professionalism and a commitment to serving the Rosemount community.
We extend our sincere gratitude to Greg and Brad for their selfless service and to their families for the
support and sacrifices made over the years.
RECOMMENDATION
Staff recommends the City Council recognize the outstanding contributions of Firefighter Greg Zeno
and Captain Brad Miller.

BACKGROUND
The 2025 Leprechaun Days Celebration will take place July 19 – 26, 2025. The celebration includes a
number of fun and entertaining events. Event information will be available in the local paper and social
media in mid-July. The Leprechaun Days event information can also be viewed online
at www.leprechaundays.org
A representative from the Committee will be attending the meeting to provide an update on this year’s
celebration.

John Zweber

Mr. Zweber is a resident of Rosemount for over 30 years. At his residence, he has turned his
front yard into a pollination area and has received several complaints regarding his yard. Mr.
Zweber was notified by the city of him violating city code. Mr. Zweber tried to apply for the
required permits in the city, but was informed that he was unable to due to the process not in
place.
Mayor Weisensel deferred to staff for a follow-up and response.

of water conservation based on MN DNR guidelines. Staff hopes to bring awareness of the importance
of following these guidelines especially during the summer months.

PUBLIC HEARINGS
a. Request by Meszaros Construction, LLC for the vacation of a portion of a drainage
easement at 2200 126th Street West.
Community Development Director Kienberger presented the request to vacate a portion of an existing
drainage easement located on the property at 2200 126th Street West. The single-family home that is
located on the property was built in 1987, and a portion of the property has wetlands located on it. The
applicant submitted a building permit application for a detached garage to be constructed on the site
where an existing shed is located. When staff reviewed the permit application, it was discovered that
there was a discrepancy between the recorded plat and the survey the city had on file for where the
easement area was located. The recorded plat showed the drainage easement area on the site to be

larger than what was depicted in the survey. It also showed that the existing shed on the site where the
proposed detached garage was to be located was located within that easement area.
Staff recommended that the applicant obtain and submit an updated property survey since there was a
discrepancy between what the wetland delineation and the recorded plat showed. An updated survey
was also needed to show that the proposed garage addition would be able to meet the required
wetland buffer setback.

6/27/25 @ 4:21 P.M.
Mayor Weisensel introduced the item noting the applicant withdrew their application on June 27th at
4:21 p.m. Community Development Director Kienberger explained that once the council packet is
published, the applicant is then notified, and in this scenario the applicant withdrew following the
publishing and it is noted as such in the packet.
Mr. Kienberger noted that applicants have the right at anytime to withdraw their application at
anytime.
Councilmember Theisen appreciates the staff time and attention with the applicant. Councilmemer
Theisen also respects the planning commission and their decision to amend the land use. The City
Council had a work session to further discuss the application and appreciated everyones' input as
part of the process.
Councilmember Klimpel acknowledged Tract and thanked them for their time and consideration for
coming to a thriving Rosemount. Councilmember Klimpel noted the City Council takes comprehensive
changes very seriously and had many reservations that certainly came up regarding this proposed
comprehensive plan amendment.

Pursuant to due call and notice thereof, a regular meeting of the Rosemount City Council was

Mayor Weisensel called the meeting to order with Councilmembers Freske, Essler, Theisen and
Klimpel.
a. FOLLOWING THE CITY COUNCIL REGULAR MEETING:
The Council may choose to reconvene the work session after the adjournment of the
regular meeting if the business of the work session is unable to be completed in the
allotted time.
DISCUSSION
a. Pedestrian Crossing Study Presentation
Public Works Director Egger provided a recap on the pedestrian crossing study.Chris Brown of SRF
Consulting Group, presented the latest updates including: final steps of the study, data anaylsis and
funding. Staff suggest going forward we take a proactive approach versus reactive approach by first
determining and addressing the highest need locations.
Mr. Brown suggested identifying and prioritizing these locations every 3-5 years, especially in a growing
city. Staff recommends building a capital improvement plan to fund the program and to start with a top
30 as the first phase. Staff will discuss with the Council each year the recommended locations to
address. Mr. Egger noted projects such as the new elementary and middle school have already been
discussed.
Councilmembers were comfortable with this process and noted this is a great starting point.
Councilmembers also requested staff review alternative solutions for some crossings for a potential cost
savings, as the current recommended solution is over one hundred thousand dollars for one location.
b. Indoor Ice
Parks & Recreation Director Schultz presented schematics of an indoor ice facility. Rosemount Area
Hockey Association (RAHA) members were present as well. Mr. Schultz noted, no location has been
determined yet but confirmed we will need approximately 7.5 acres.
The costs for everything is approximately 38 million for two sheets, based on numbers that have been
out there in the industry. This number is based on it being built in 2026. For a phased approach, one
sheet is approximately 22.7 million and at a later date for a phase 2 add-on it would be approximately
16 million. Staff further discussed the financial options to build this facility; i.e. bond, referendum,
potential partners, possible donations.

Councilmember Theisen stated it would be helpful to understand the economic impact a facility like this
would bring. Staff will prepare findings from other cities and show the Council at a later date.
Councilmember Freske would like to see who the city could work with for possible sponsors or
individuals to assist with funding the project. In addition, Councilmember Freske requested an
agreement with RAHA be in place stating the number of tournaments that must take place in
Rosemount to bring in the economics.
Staff will continue to gather information and provide to the Council at a later date.

c. 2025 Goals Mid-Year Check In
Mayor Weisensel made a motion to reconvene the work session meeting back at 7:38 p.m.
City Administrator Martin highlighted the goals and initiatives for 2025-2026 and checked in on the
status within each department. City Councilmembers thanked staff for another great year.
d. Preliminary 2026 Budget discussion
City Administrator Martin presented the first high-level review of the 2026 budget and, in August, staff
will dive more into the numbers. Mr. Martin highlighted key items in the budget; new full time Police
Officer, promotion to Police Captain, new GIS Analyst, Fire Marshal, Fire Administrative Specialist
position and a placeholder for medical and dental insurance.
Councilmembers requested that any safety fund dollars should go towards the Fire Department and
they are comfortable with an overall gradual increase to the budget. Councilmember Freske questioned
the use of Artificial Intelligence before the City continues to add bodies and any new revenues should
be used for capital projects due to the growth of the City.
Councilmember Essler suggested based on the taxable value being added to the city, staff shouldn't be
comparing our increase to other cities and we should be living with the means of our growth.
Staff will continue to review the budget and will provide a closer look at the August work session.
UPDATES

Parks and Recreation Director Schultz provided an update of upcoming events; Grill Your Ace and
Leprechaun Days.
Community Development Director Kienberger stated the Speedway demolition is set for July 14th.
City Clerk discussed upcoming events including Leprechaun Days.

RECOMMENDED ACTION: Staff recommends the Council adopt the attached resolution enacting

BACKGROUND
With recent extensions of Connemara Trail east of Akron Avenue and Aspen Avenue between CSAH 42
and Connemara Trail, along with continued growth in the immediate area, a request to enact standard
parking restrictions on these two collector road segments is needed. This is a similar standard
previously applied on other collector roads in the City.
Generally speaking, the City prohibits parking at any time along collector road corridors as a standard
practice to maximize mobility of traffic and to ensure clear and efficient responsiveness by first
responders.
Staff is recommending the Council enact enforceable parking restrictions along both sides of
Connemara Trail east of Akron Avenue, and on Aspen Avenue from County State Aid Highway 42 to
Connemara Trail.
RECOMMENDATION
Staff recommends the Council adopt the attached resolution enacting parking restrictions on
Connemara Trail and on Aspen Avenue.

BOTH SIDES OF CONNEMARA TRAIL EAST OF AKRON AVENUE, AND BOTH SIDES OF
ASPEN AVENUE BETWEEN CSAH 42 AND CONNEMARA TRAIL
WHEREAS, the City Council of the City of Rosemount is interested in the safety of its residents and
visitors and the safe movement of traffic; and,
WHEREAS, Connemara Trail Street is the main east-west local collector roadway within the entire City of
Rosemount, and
WHEREAS, Aspen Avenue between County State Aid Highway 42 and Connemara Trail serves as a minor
collector road segment to serve as access to adjacent commercial and high-density residential properties, and
was not designed to accommodate on-street parking, and
WHEREAS, the City of Rosemount has consistently prohibited parking on both sides of collector
roadways elsewhere in the City in order to maintain maximum mobility and flow of motor vehicle traffic for
the benefit of the traveling public and for ensuring expedient public safety responses from Rosemount
Police, Fire, and Public Works.
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Rosemount hereby
prohibits parking on:
•Both sides of Connemara Trail east of Akron Avenue to its existing terminus
•Both sides of Aspen Avenue between County State Aid Highway 42 and Connemara Trail
The Public Works Department is hereby directed to install permanent signage to denote said parking
restrictions.

BACKGROUND
In the spring of 2025, the City Council approved a service agreement with the Leprechaun Days
Committee. As in years past, street closing requests and the addition of events to the service
agreement have been brought to the City Council for approval.
The current requests for street closings include:
1. Big Wheel, Trike and Scooter Races plus Penny Scramble - Wednesday, July 23 - 5:00 pm to 8:30
pm, Burma Avenue from 145th Street to 146th Street.
2. Mid-summer Faire - Closing of 145th Street at Burma Avenue to Burnley Avenue on Thursday,
July 24 from 5:00 – 11:00pm, Friday, July 26 from 5:00pm - 11:30pm and Saturday, July 27 from
4:00pm – 12:00am.
3. Parade - Saturday, July 26 - 8:30 am to 1:30 pm or as soon as the parade ends.
At 8:30 am 145th Street will be closed at Diamond Path and at Cimarron Avenue; Cobalt, Dallara, and
Davenport Avenues will be closed at 145th Street West; and Shannon Parkway will be closed at 144th
Street and at Dodd Road.

BACKGROUND
M/I Homes, Inc. approached the City with a request to place a monument sign marking the Alder Glen
at Amber Fields neighborhood within a section of a drainage and utility easement near Akron Avenue
and Adamstown Drive. Typically, the City prohibits structures in these easements to avoid interference
with infrastructure access and functionality, such as drainage swales and underground utilities.
In this case, the encroachment request is minimal and would allow unimpeded access to the
underground storm sewer pipes, with very low associated risks. As a result, the City considered
permitting the encroachment through a formal agreement. The attached agreement specifies the
conditions and limitations of allowing the placement of the monument sign in this location and
preserves the City’s right to require its removal in the future if necessary, with no obligation to
compensate the owner of the sign for any associated costs or hardships.
RECOMMENDATION
Staff recommends that the Council approve the attached encroachment agreement, authorizing the
Mayor and City Clerk to affix their signatures.

ENCROACHMENT AGREEMENT
THIS ENCROACHMENT AGREEMENT (“Agreement”) made and entered into as of
this day of , 2025, by and between M/I Homes of
Minneapolis/St. Paul, LLC, a Delaware limited liability company, (“Owner”) and the City of
Rosemount, a Minnesota municipal corporation (“City”).
RECITALS
A.The Owner is the fee owner of certain real estate located at 15431 Altamonte Way in the
City of Rosemount, Minnesota, (PID No. 34-1126-70-1120) legally described on the
attached Exhibit A (“Property”).
B.The Property is subject to and bounded on all perimeters by the platted drainage and
utility easement all as shown on the plat of AMBER FIELDS EIGHTEENTH
ADDITION (“Easement”).
C.The Owner desires to construct a monument including signage for the property
development on the Property, which, once constructed, will be partially located within
said Easement contrary to local laws and regulations (“Encroachment”). The location
of the Encroachment is legally described on the attached Exhibit B and depicted on the
attached Exhibit C (“Encroachment Area”).
D.The City is willing to allow the Encroachment to be constructed and to remain within
the Encroachment Area subject to the terms and conditions contained in this Agreement.
AGREEMENT
1.Incorporation of Recitals. The recitals set forth above are incorporated herein and
made part of this Agreement.
2.Grant of Limited Use Within Encroachment Area. The City warrants that it has the
right to grant this limited use of the Encroachment Area. The City grants the Owner the
right to encroach into the Encroachment Area for the sole purpose of constructing and
maintaining the Encroachment. The permission granted by the City under this
Agreement is limited exclusively to such purpose. This Agreement only creates a license
to construct and maintain the Encroachment and does not create any interest in real
property.
3.Scope. The City reserves the right to use its Easement for drainage and utility purposes
and all rights included therein, including the Encroachment Area for its own purposes.
The City may take any action necessary to exercise its interest in its drainage and utility
easement or the platted easement area, including excavation which may render the
Encroachment Area unusable. In the event the Encroachment Area becomes unusable
for the use contemplated herein, the Owner will have no claim against the City.

4.Maintenance and Repair. The Owner must construct, repair, and maintain the
Encroachment in a sound manner, as may be determined by the City Building Official,
City Engineer or other designated City official.
If Owner fails to construct, repair, or maintain the Encroachment during the term of
this Agreement, such limited use granted herein may be revoked by the City.
5.Hold Harmless; Indemnification. All claims that arise or may arise against the
Owner, its agents, or contractors while engaged in their use of the Encroachment Area
will in no way be the obligation of the City. Further, the Owner will indemnify, hold
harrii1ess and defend the City, its officials, employees, contractors and agents front
and against all liability, loss, costs, damages, expenses, claims, actions or judgments,
including reasonable attorneys’ fees which the City, its officers, employees, agents or
contractors may sustain, incur’, or be required to pay, arising out of any act or failure
to act by the Owner, its agents or contractors kinder this Agreement, including if the
Encroachment becomes damaged during the course of the City exercising its easement
rights to the underground utilities in the Easement. Nothing in this Agreement is a
waiver by the City of any immunity, defenses, or other limitations on liability to
which the City is entitled by law. Further, the Owner is responsible for the costs
related to any damage to utilities within the Encroachment Area caused by the Owner,
its agents or contractors.
6.City Access to Utilities; Termination. The City reserves the right to terminate this
Agreement if the City intends to construct or repair utilities to be located within the
Easement, requiring excavation within the Easement. If feasible with the City’s
construction plans, in the City’s discretion, the City and the Owner may enter into a
separate agreement or temporary easement to allow for the City’s work within the
Easement or on other areas of the Property without termination of this Agreement.
The Owner will be responsible for’ all costs associated with excavation and
restoration of the Property and the Encroachment Area. Upon termination of this
Agreement, Owner must immediately remove the Encroachment and any other
personal property from the Encroachment Area at Owner’s sole cost.
7.Notices. Any notice, demand, or other communication under this Agreement by either
party to the other will be sufficiently given or delivered if it is dispatched by certified
or registered mail or delivered personally to the address below:

BACKGROUND
The 2026 Street Improvement Project (SIP), City Project 2026-01 is part of the 2025 - 2034 Capital
Improvement Plan. The streets were identified for this improvement through the city's pavement
management program as shown in the attached map. The project is proposed to rehabilitate the
pavement, repair damaged curb, spot repair utilities, and upgrade the pedestrian ramps.
Bolton & Menk, Inc. (BMI) has provided a proposal to perform the engineering services related to this
project. They are familiar with the City of Rosemount and previously worked on the 2021 Street
Improvement Project, Bonaire Path Reconstruction and Biscayne Avenue Reconstruction. Their
proposal is $173,856 and 1,443 hours in direct effort and expenses, along with $26,000 for
subconsultant expenses for pavement analysis and material testing. This results in a total contracted
amount of $199,856. This proposal was selected from a total of 5 proposals and will provide the
necessary engineering effort to complete the feasibility report, pavement analysis, preliminary and
final design, bidding, construction administration, public communication and material testing for the
2026 SIP.
The project scope includes pavement rehabilitation on the following streets:
• 158th Street W between a point 560 feet east of Danville Avenue and Dakota Lane
• Dakota Drive between a point 325 feet east of Danville Avenue and Dakota Lane
• Dakota Lane between 158th Street W and 160th Street W (CSAH 46)
• Cardinal Court between the cul-de-sac and Cardinal Street W
• Cardinal Street W between Cardinal Court and Cicerone Path
• Cardinal Circle between the cul-de-sac and Cardinal Street W
• Crystal Path between Shannon Parkway and Cardinal Street W
• Cinnamon Way between Shannon Parkway and Cardinal Street W

In addition to street rehabilitation, there are several other work items included in this project. A
number of stormwater catch basins will be inspected and reconstructed to current standards as
needed; hydrants replaced if needed; valves will be replaced and added as necessary and manhole
castings will be replaced or upgraded.
The attached resolution orders preparation of a feasibility report which is a necessary step under
Minnesota Statute Chapter 429. This chapter specifies the actions that must be taken in order to assess
property owners for all or a portion of the cost of local improvements. The feasibility report will
provide information regarding whether the proposed improvements are necessary, cost-effective and
feasible.

BACKGROUND
Public improvements installed as part of Caramore Crossing 3 Addition, City Project 2022-10 include

construction season, with the wear course paved in 2024.
The developer has provided as-built documentation, and lien waivers. Staff has requested final
invoices for the installed work.
RECOMMENDATION
Upon City acceptance of the work, the public improvements constructed in Caramore Crossing 3
Addition, City Project 2022-10 shall become City property per the subdivision agreement. Staff
recommends that City Council adopt the resolution accepting the improvements for perpetual
maintenance.

BACKGROUND
City staff have been diligently working toward closing out the 2023 Neighborhood Improvement
Project, City Project 2023.04. The City accepted the infrastructure and has been awaiting a final pay
application since November 2024. The Contractor, Northern Lines Contracting, Inc., has not submitted
the final paperwork required by the Contract Documents and Minnesota Statutes that are necessary to
close out the Project. The City has had ongoing correspondence with the Contractor to try to obtain
the required paperwork, with no success.
On June 26, 2025, the City Attorney’s Office sent a letter to the Contractor and its attorney notifying
them that they are in default, they have 10 days to cure the default, and that the remaining contract
balance would be released to them if they submitted the required paperwork. The remaining contract
balance is $30,916.67, which accounts for a deduction of $47,500 in liquidated damages for the
Contractor’s significant delays on the Project. (Northern Lines was first notified of the City’s
assessment of liquidated damages in December 2023.)
Northern Lines has not cured the default. Therefore, staff and the City Attorney are recommending
that the Council approve the attached Resolution terminating the Contract to close out the Project.

WHEREAS, City staff repeatedly reached out to the Contractor in an effort to obtain all
required paperwork to close out the project, with no success; and
WHEREAS, the remaining balance owed to the Contractor under the contract is $30,916.67
after deduction of liquidated damages in the amount of $47,500 due to significant delays on the
Project by the Contractor; and
WHEREAS, on June 26, 2025, the City Attorney’s Office sent a letter to the Contractor

The Rosemount City Council is being asked to consider four requests submitted to the City by Aspen
Field, LLC. The applicant is asking the City to amend its Comprehensive Land Use Plan, rezone the

subject property into conformance with the proposed Land Use Plan amendment, and to approve
preliminary and final plats to create four parcels and one outlot. The subject property is located 1/4
mile east of Akron Avenue at the intersection of Aspen Avenue and 145th Street East (CSAH 42). The
subject property contains the site of the former Rosemount City Hall and a former residential property
in the southwest corner of the site. Until recently, the City Hall site has been owned by DCTC and used
for various training activities. The residential structure was removed within the past two years.
The site is located immediately east of the new Life Time facility and the commercially-guided land
south of the facility. Immediately north of the subject property is an outlot containing stormwater
infrastructure, and on the other side of Connemara Trail is the Emerald Isle subdivision. A site that is
guided and zoned for high-density residential development abuts the eastern site boundary. In 2024,
DevCo received approval to construct a project on that site consisting of two apartment buildings.
South of the subject property, across CSAH 42, is Dakota County Technical College.
The Planning Commision recommends approval of these requests with the exception of the final plat,
which is solely the purview of the City Council. It should be noted that the rezoning and plat approval
requests hinge on the approval of the proposed Comprehensive Land Use Plan amendment. At this
time, the applicant has not submitted a request for a site plan review. Approval of the site plans for the
development of each of the parcels will be required before the City can issue any building permits for
construction. A concept plan was submitted with the applications to give staff and the Planning
Commission an idea of what to expect on the site when it develops. The recommended action is based
on the information outlined in the rest of this report.
PLANNING COMMISSION ACTION
The Planning Commission reviewed these requests and held a public hearing to receive comments
during its June 24 meeting. The Planning Commission asked about the pipeline easement that runs
through the property to understand how it would constrain the property. The applicant provided
insight into the conversations they've been having with the owner of the pipeline easement. The
applicant has negotiated a verbal agreement that parking lots can be placed over the easement and a
building could encroach into the easement area by ten feet. This is primarily due to the pipeline no
longer being in use. The applicant also discussed potential end users of the site, but it is still early in the
process.
The Commission sought to understand the current land use designation and why the subject property
wasn't designated for other uses at that time. Staff explained how the site had been actively used in
conformance with its designation of Public/Institutional at the time of the latest update, and there was
no indication at that time that DCTC would be selling the property. The Commission also asked for
additional context related to the amount of acres designated for commercial uses in this part of the
City. Staff shared with the commission how many acres of commercially-designated land are still
available. For example, the subject property is about 10 acres in area, which is comparable to the site
owned by Jerry's Foods, and half the area of the commercially-guided land further east. The
Commission also discussed where future residential or commercial development might occur. Staff
offered context about the different owners of land east of the subject parcels, such as Flint Hills
Resources and Meta. Lastly, before opening the public hearing, the Commission discussed site access
to confirm its understanding of how traffic would move into and around the site.

The Commission received public comment from four residents whose primary concerns related to
traffic and the impacts of the development on adjacent neighborhoods. There was a question of what
could be built on the site under the current land use designation. As it is currently designated,
development of the site would be limited to schools, municipal buildings, etc. The public commentors
asked what businesses would go in the commercial spaces, and staff described to the Commission how
the market drives development.
The Commission acknowledged how the City has developed over the years, and that development in
the area of Akron and 42 is the current area of growth. The Commission expressed its understanding of
the desire for services and retail in this area by residents. The Commission voted unanimously to
recommend approval of the requests.
Legal Authority The decisions the City Council is being asked to make are both legislative and quasi-
judicial in nature. Decisions to approve Comprehensive Plan Amendments are always legislative in
nature as they are essentially policy decisions that reflect the City Council's vision for the growth and
development of the community. There is broad discretion in approving or denying such requests.
Rezoning actions are also technically legislative, but they should be consistent with the adopted
Comprehensive Plan. The approval of plats is quasi-judicial, and the Council is being asked to
determine if a proposed plat meets the standards of the zoning ordinance. If the Council finds that to
be the case, the Plat should be approved.
COMPREHENSIVE PLAN AMENDMENT
As stated above, Comprehensive Plan Amendment approvals are legislative decisions. Therefore, when
staff reviews such requests and presents them to the Planning Commission and City Council, its
recommendation is based on goals, policies, and objectives elsewhere in the Plan as well as the
parameters laid out for the proposed land use designations, such as location criteria and minimum
requirements for development like road access and municipal services.

The proposed land use designations add to the existing CC and HDR districts to the east and west of
the site. The site is situated between a collector road (Connemara Trail) and an arterial (CSAH 42).
Access to the site would be made from Aspen Avenue and Connemara Trail.
The City has, in recent years, created a vision for development at specific nodes along CSAH 42. The
subject property had not been included in the visioning exercises in which the City Council and
Planning Commission participated. This was primarily because the subject property was owned by

DCTC and the City did not know if or when the land would be available for development. The proposed
amendment is consistent with the vision for development of the land immediately adjacent to Akron
and 42 with commercial uses along the major frontages and residential uses behind them.
A consistent request from residents, which has been reflected in the City's ongoing support for
commercial development in this area, is that more services, retail, and entertainment are needed in
this part of the City. The proposed Comp Plan amendment adds land for commercial development. The
concept plan included with the application submittal envisions two commercial strip centers and a day
care center.
While the City has seen several important commercial projects develop (LifeTime, Kwik Trip, First State
Bank/Sweet Kneads), commercial development remains slow in this part of the City. The key constraint
to commercial development remains the lack of a complete, 360-degree trade area around the Akron
42 intersection. THis is an important data point used by commercial developers building grocery stores,
restaurants, and retail when identifying sites for new locations. To the east, a significant amount of
land that could otherwise be developed with housing is owned by Flint Hills to be maintained as a
buffer from its Pine Bend refinery. South of 42 contains DCTC and UMore Park land that will not be
able to be developed for residential uses until at least 2040 when Dakota Aggregates lease ends, and
also when environmental remediation of other areas takes place. A gap exists between how much land
is able to develop as single-family homes and townhomes, and what is needed to attract and support
businesses in this part of the City. The development of multifamily housing in strategic areas that are
well served by streets and roads and in proximity to commercially-guided land will help fill that gap and
support commercial development.
Supporting commercial development at Akron and 42, which is listed as a goal and policy of Chapter 3
of the Comprehensive Plan, is not the sole reason staff is recommending approval of the amendment.
Other goals and policies laid out in the plan include providing appropriate transitions between land
uses. The positioning of the proposed HDR district in the subject property buffers the neighboring low-
density residential from the intensive commercial uses along CSAH 42 and from CSAH 42 itself. Chapter
4: Housing identifies the provision of a mixture of rental and homeownership opportunities to create
life-cycle housing as a goal and policy of the City. It specifically calls for locating high-density
residential development adjacent to collector and arterial streets and locating this type of
development in conjunction with commercial areas along 42 to create mixed-use neighborhoods and
transit-oriented districts. To the last point, MVTA recently announced changes to Route 420, which
serves Rosemount. The route will be extended from its current terminus at the Rosemount Transit
station near City Hall to include service to DCTC. This extension, combined with the planned trail
underpass below County Road 42, will create connections between this area through Rosemount and
to Apple Valley's transit station.
REZONING
The applicant has requested a zoning map amendment that would change the zoning classification of
the subject property from its current placement in the Public Institutional district to B-1 General
Commercial and R-4 High Density Residential. Both zoning districts are consistent with the proposed
Comp Plan Amendment. Therefore, staff is recommending approval of the rezoning subject to the
approval of the Comprehensive Plan Amendment.

PLAT
The applicant has submitted a proposed plat that would create 3 commercial parcels and one parcel to
be used for multifamily development. Additionally, the plat contains an outlot to contain stormwater
infrastructure. The zoning ordinance contains specific lot standards to which new plats must comply.
This report reviews the proposed plat against the proposed zoning districts each parcel would be
located in if the rezoning is approved. These standards are compared to the proposed plat in the table
below.

The Planning Commission recommends approval of the Preliminary Plat. Final Plat approvals are solely
the purview of the City Council. Staff finds the final plat to be consistent with the preliminary plat, and
recommends City Council approve the Final Plat with the preliminary plat.
Engineering
As part of the plat approval, the City's engineering staff has reviewed the proposed plans for
conformance with City's engineering standards. The subject property includes two wells in the western
portion of the site. Because these are active wells currently being used by the City, a 50' buffer area
around the wellheads must be maintained. The proposed plat includes easements over the wells and
buffers. These wells were installed for the University of Minnesota for development within UMore
Park, and the University retains ownership of those properties. The City is working with the University
to transfer ownership of the well properties, which may require continued coordination with the
developer. It is anticipated that the process for transfer will be a Quit Claim Deed from the University
to the City. Eventually, the developer will have to define the boundaries in the final plat document and
in development plans.
The attached engineer's review memo references capping and sealing existing wells. This is in
reference to the wells used by the former dwelling and existing old City Hall building. Utilities and
roads within the proposed development area will be privately owned and maintained. Easements are
provided in areas containing utilities and infrastructure. A requirement included in the recommended
conditions of approval is that the developer grade in and prep a trail along CSAH 42, which is consistent
with a requirement of the Parks and Recreation department as highlighted in the following section.
Parks
The Rosemount Parks and Recreation Director has reviewed the proposed plat and has provided a
memorandum which is included in the attached documents. Staff is recommending the City collect a
fee-in-lieu of park land dedication for this development to be collected with the issuance of building
permits. The cash dedication for the commercial portion of the site is $40,500 (4.5 acres x $9,000 per
acre). Because a site plan has not been submitted for review, the required fee is estimated based on a
potential 150-unit apartment building. That amount would be $375,000 (150 units x $2,000/unit). The
final amount will be calculated and applied during the building permitting process. Staff is also

recommending the developer be required to include a sidewalk along the east side of Aspen Avenue
between CSAH 42 and the northern boundary of the subject parcel.
RECOMMENDATION
The Planning Commission and staff are recommending approval of the submitted requests. This
recommendation is based on the materials submitted by the applicant, goals and policies identified in
the City's comprehensive plan, and information detailed in this report. The recommended actions
related to the proposed plat and rezoning are subject to the approval of the proposed Comprehensive
Land Use Plan Amendment. Prior to development of any of the parcels created by the proposed plat,
review and approval of the Site Plans by the Planning Commission will be needed.

a. Aspen Fields Land Use Plan Amendment, Rezoning, and Plat Approval Request
Planner Nemcek presented a request by Aspen Field LLC for a land use plan amendment, rezoning,
and plat approval. Nemcek discussed the nature of the requests and decisions. He showed the site
location, proposed land use changes, and explained what could be expected to be built on the parcel.
He also stated support for the amendment backed by the comprehensive plan from the Land Use
and Housing chapters. He explained the MVTA will be expanding their transit routes to the area.
Nemcek discussed residents' desire for more commercial in the area. He explained that commercial
development is slow to develop in the area because the land to the east and south would not be used
for residential development. He clarified that this is because the area to the northeast is owned by
Flint Hills, the area to the south is DCTC and to the southwest the area is being used by Dakota
Aggregates. He showed the proposed zoning change. He also stated that there would be four parcels
on the plat and showed the proposed plat. Nemcek described issues with the site caused by
easements and wells. He reminded that building permits will need to be reviewed before any
development can happen.
Nemcek discussed access, landscaping, and engineering plans. He also stated that Parks and
Recreations staff recommend a fee-in-lieu of land to be collected with the building permits and that
the developer bench a trail. Nemcek said that there are additional approvals still needed for the
project to move forward. Staff recommended approval. Nemcek noted that condition D changes the
wording, so the developer should install the sidewalk up to the northern boundary of the property,
but not along the city-owned land.
Commissioner Ellis asked about the parcel being cut off by the road. Nemcek responded that it
would be right of way in the final plat. Commissioner Ellis asked about the pipeline easement.
Nemcek responded that the pipeline is no longer in use and the easement may be vacated. He also
stated that sometimes parking lots are allowed over easements.
Commissioner Beadner asked why the 2040 plan would still include the land as zoned public
institutional. Nemcek responded that at the time of the comprehensive plan, DCTC was not
indicating that the land would be sold in the near future. Commissioner Beadner asked about the
parcel being all commercial. Nemcek responded that it was something that could be discussed but
staff's recommendation is mixed use. He showed the proposed land use again. He reiterated that the
staff's opinion was that there was enough land guided for commercial when taking into
consideration the land to the east guided for commercial.
Chairperson Reed asked about the size of retail. Nemcek responded that there would likely be three
or four bays per parcel and compared it to other areas in the city. Commissioner Arnob asked about
access to each particular parcel. Nemcek responded that it would all be private, so the city would not
be the one regulating it. Commissioner Rivera asked about the Aspen access. Nemcek responded
that it is a right-in, right-out only.

John Anderson, applicant’s representative
Anderson stated that he represented Aspen Field LLC. He clarified that they have an active buyer
for the daycare and that section of the site plan was designed for it. He also stated that they have
several prospective buyers they are talking to about the high-density project. He discussed the
pipeline easement and the high cost of vacating the easement and removing the pipeline. He stated
that parking lots are able to be built within the easement. Anderson also discussed the decision to go
in this specific direction with what will be on each parcel.

Evans asked what the zoning is currently on the property. He also asked how many apartment
buildings need to be built to draw in commercial development. He expressed concerns about the
number of apartment buildings in the area and the traffic that could be brought in. He expressed
safety concerns about children in the area and traffic. He asked if there was anything that could
make it easier to access the other side of Akron Avenue aside from the roundabout. He asked about
residential development in the Amber Fields area. He also asked about the train and backups with a
possible increase in traffic.

Lopez expressed concerns over traffic and safety issues that might come with a high-density
residential development. She also stressed that there are several daycares in the area and also
expressed concerns over what else may go in the commercial sites.

Klin also expressed concerns over traffic and safety. He stated that he didn't feel that the
infrastructure could support the high-density residential and believed commercial would be a better
fit.

Nemcek stated that the only things that could be built on the property currently are public
institutional. He identified the Amber Fields development plan has 1900 housing units, so residents
should not be concered about five to ten thousand new residents. Nemcek also noted that public
works could be followed up with on traffic and safety concerns. Kienberger responded that the
roundabout construction is the main thing he knows about. Reed asked about safety and community
input for the roundabout. Kienberger responded that it was already finalized and was a county

project. Chairperson Reed asked about safety on Connemara. Nemcek responded that the road was
designed as a collector for County Road 42, so it would be able to handle the traffic. He also said
that the traffic safety committee will work with residents on their concerns. Kienberger also noted
that the plan for Connemara Trail was to continue eastward and connect to Blaine Ave.
Nemcek stated that the city has no power over what businesses go in and can only determine what
uses are allowed. He also noted that the land on the southwest corner of Akron Avenue and County
road 42 is expected to become a grocery store. Nemcek also stated that commercial development

Subject: Aspen Fields Project
The Parks and Recreation Department recently reviewed the plans for the Aspen Fields project.
After reviewing the plans, the Parks and Recreation Department staff has the following comments:
Parks Dedication
Commercial Development - The parks dedication requirement for a commercial development is
either a 10% of the total property area as land dedication, a cash dedication in-lieu of land or
combination of the two.
Staff is recommending that the City collect cash in-lieu of land for the development that is currently
being processed. The cash dedication for the 4.5 acres of commercial development is $40,500 (4.5
acres x $9,000 per acre). This amount is to be paid when the building permit is issued.
Residential Development - The parks dedication requirement for 150 high density residential units is
.02 acres of land per unit or $2,500 per unit. The City’s Parks Master Plan does not call for a park in
this area, so staff is recommending the City collect cash in-lieu of land to meet the parks dedication
requirements. The cash dedication for 150 units would be $375,000 (150 units x $2,500 per unit).
Trails and Sidewalks
Staff is recommending the developer install a sidewalk on the eastside of Aspen Avenue from
Connemara to County Road 42. Staff also recommends that a 10-foot-wide trail be benched/graded
in on the south side of development along County Road 42 for a future trail to be installed by
Dakota County.

Civil Comments:
1. General
a. Submit for and provide copies to the City of all required permits from regulatory
agencies (MCES, Minnesota Pollution Control Agency, Minnesota Department of
Health, NPDES, etc.)
b. Coordinate any grading or construction work with the utility provider
i. Future building shown encroaching into gas easement
c. Address redline comments on attached plan sheets
2. Utilities
a. Applicant to submit for Minnesota Department of Labor plumbing plan review and
provide approved plans to City prior to permit issuance
b. Abandon/Cap existing wells per MDH requirements
i. Show and verify existing sanitary sewer facilities to remove/abandon

Grading, Drainage, and Erosion Control Comments:
1. General

2. Grading Plan
a. Add a callout for the snowmelt event HWL on the plans.
b. Label EOF locations and elevations for all low points.
c. Define maintenance access routes to the stormwater infrastructure.
d. Provide all inlet elevations
i. Proposed contours do not match up with proposed inlets
e. Maintain minimum 2% slope with swale
3. Erosion Control
a. Add inlet protection to the catch basins on Aspen Avenue.
b. Revise the impervious total listed on the SWPPP and site plan to match.
Stormwater Management Plan:
1. General
a. Submit a stormwater report with drainage area maps to document how
stormwater management is achieved. Refer to the stormwater management
report for Talamore and Lifetime for the drainage breaks that were used in the
regional pond designs.
b. Submit soil borings.
c. Provide an operations and maintenance plan for the stormwater basin.
d. Discussions needed with adjacent property owner to pipe pond outlet to future
Emerald Isle BMP location.
2. Modeling
a. Include the 10-day 100-year snowmelt event in the HydroCAD model.
b. Include the drainage area outputs in the HydroCAD report.
c. Include the .hcp version of the model.
d. The site plan shows 6.5 acres of proposed impervious. Modeling includes 2.2
acres of proposed impervious. The plans and model should match.

3. General Storm Sewer Design
a. All storm sewer facilities shall be designed to accommodate a 10-year rainfall
event. Provide rational calculations and a drainage area map.
b. The minimum lateral pipe size shall be 15” in diameter. What is the 12” pipe
stubbed off of CBMH-203?
c. Storm sewer structures in unpaved areas shall be marked per the City’s
Structure Marker Sign Detail.
d. Inlets are required every 300’ along streets. Provide calculations showing that the
inlets receive a maximum of 3 cfs for the 10-year design storm.
e. Add catch basins on the private drive upstream of the intersection with Aspen
Avenue.
f. Label the orifice size on the skimmer detail.
4. Freeboard
a. Provide at least 1.5 feet of separation from the emergency overflow elevation of
the low points to the building low opening.
5. Water Quality
a. Provide NURP pretreatment (dead storage volume equal to 2.5” of runoff from
the contributing drainage area) prior to water leaving the site.
b. All site impervious should have a plan for stormwater management. A portion of
the private road leaves the site untreated.
General
Infrastructure design shall be completed in accordance with the City of Rosemount’s Engineering
Guidelines and Standards. Infrastructure construction shall be completed in accordance with the
latest edition of the City’s General Specifications and Standard Detail Plates for Street and Utility
Construction.
